BIHAR SECRETARIAT CANTEEN MANAGER GROUP RULES, 2017

PREAMBLE

In exercise of powers conferred under proviso to Article 309 of the Constitution of India, the Governor of Bihar, is pleased to make the following Rules for the Post of Manager cadre, Bihar Secretariat Canteen.

Rule - 1. Short title, extent and commencement.--

(i)       These Rules may be called as 'Bihar Secretariat Canteen Manager Group Rules, 2017;

(ii)      It shall extend to the Bihar Secretariat Canteen, Patna.

(iii)     It shall come into effect immediately.

Rule - 2. Definitions.--

 In these rules, unless otherwise requires in the context-

(i)       'State Government' means, State Government of Bihar;

(ii)      'Appointing Authority' means, the Labour Commissioner, Bihar, Patna;

(iii)     'Department' means, the Labour Resource Department;

(iv)    'Cadre' means, the manager cadre of Bihar Secretariat Canteen under the control of Labour Commissioner, Bihar;

(v)      'Cadre Controlling Authority' means the Labour Commissioner, Bihar, Patna.

(vi)    'Promotion Selection Committee' means, the Selection Committee constituted under rule-8(2) of these Rules;

(vii)   'Commission' means, the Bihar Staff Selection Commission;

Rule - 3. Cadre Structure.--

This cadre shall be confined to the Bihar Secretariat Canteen. There shall be following three categories of posts in this cadre:-

(a)      Assistant Manager- Basic Category.

(b)      Deputy Manager- First promotional level.

(c)      Manager-Second promotional level.

Rule - 4. Authorized Strength.--

(1)     The department will determine the authorised number of posts in this cadre and may create also permanent and temporary posts besides this, or may put any post under suspension or vacant.

(2)     The pay scale shall be deemed automatically revised/amended in the light of revision/amendment made by the state government from time to time.

Rule -? 5. Reservation.--

Compliance of reservation policy and roster determined by the state government from time-to-time will be compulsory in this cadre.

Rule - 6. Qualification.--

There shall be following qualifications/conditions for direct appointment of the candidates in this cadre:-

(i)       Educational qualification shall be graduate or degree in Hotel and Catering Management from recognized institution.

(ii)      The minimum age will be 21 years and the maximum age will be the same as if may be determined by the government from time to time.

(iii)     Minimum 3 years working experience at the managerial level or supervisory level in any recognized hotel.

Rule - 7. Recruitment.--

(1)     Direct appointment to the post of assistant manager will be made on the basis of Competitive Examination held from time to time, by the Bihar Staff Selection Commission for this purposes. The procedure of examination and syllabus will be determined by the department in consultation with the Commission.

(2)     The appointing authority shall calculate the vacancies on the basis of 1st April every year and shall send the requisition to the commission by the 30th April. The eligibility of age will be as per the 1st August of the vacancy- year.

Rule - 8. Promotion.--

(1)     Appointment to the higher post from the assistant manager shall be given on the basis of recommendation of Departmental Promotion Committee constituted at the secretariat level.

(2)     The promotion committee constituted to decide the promotion matter will be as follows:-

(A)     Principal Secretary/Secretary, Labour Resource Department------Chairperson

(B)     Labour Commissioner, Labour Resource Department------Member- Secretary

(C)     A representative from General Administration Department--------------Member

(D)     One representative each from SC/ST, minority and woman quota------Member.

(3)     Provisions relating to kalawadhi determined by the General Administration Department from time to time, will apply.

(4)     Promotion to the post of manager will be given on the basis of seniority and recommendation of The Departmental Promotion Committee.

Rule - 9. Probation Period/Confirmation.--

The newly appointed Assistant Manager will be declared on probation from the date of appointment. The probation period will be for two years. The Appointing Authority will confirm the appointment after the successful completion of probation period, satisfactory service in the said period and after passing the prescribed examination including computer examination. If the probation period is not satisfactory, it may be extended for another one year, with reasons to be recorded but in any case the probation period will be more than three years. He may be removed from service, if his service is not found satisfactory during the extended period.

Rule - 10. Training.--

It will be essential to obtained training determined by the state government, from time to time. The administrative department will prepare a training program for this.

Rule - 11. Determination of Seniority.--

(1)     The Labour commissioner, Bihar will determine the seniority list of the Manager and communicate it.

(2)     Inter-se-seniority of the persons appointed on the basis recommendation of commission under sub section (1) of Rule-7 will be in merit order.

Rule - 12. Residuary Matters.--

With regards to matters not covered by these rules, the members of the cadre shall be governed by the Rules, Regulations and Orders applicable to the other employees of the appropriate level of the state government.

Rule - 13. Removal of Difficulties and interpretation.--

Where any doubt arises as to the interpretation of any of the provisions of these rules, the matter will be decided by the Appointing Authority after consultation with the Law Department.

Rule - 14. Repeal and Savings.--

(1)     All resolutions and instructions issued earlier before the implementation of these Rules with respect to this cadre are hereby repealed.

(2)     Notwithstanding such repeal, anything done or any action taken under the said resolutions, instructions shall be deemed to have been done or taken under these rules as if these Rules were in force on the day on which such thing or action was done or taken.
