And Technical Services Rules, 2021

Department...........In exercise of the powers conferred by proviso of Article
309, of the constitution of India read with Section 55 and Section-94 of Bihar
Police Act, 2007, the Governor of Bihar is pleased to make the following rules
to amend the Telecommunications, Subordinate Officer (Operation) Recruitment,
Promotion and Cadre Rules, 1989 (as amended from time to time), as follows:-
Rule - 1. Short title, Extent and commencement :-
(1)
These Rules will
be called the "Bihar Police Telecommunications (Wireless) and Technical
Services Rules, 2021".
(2)
It shall extend
to the whole of the State of Bihar
(3)
It shall come
into force with immediate effect.
Rule - 2. Definitions :-
In these
rules unless the context otherwise requires-
(i)
"Government"
means Bihar Government;
(ii)
"Department"
means Home Department (Police Branch), Government of Bihar;
(iii)
"Selection
Board" means Central Selection Board;
(iv)
"Subordinate
Service Commission" means Bihar Police Subordinate Service Commission;
(v)
"Commission"
means Bihar Public Service Commission;
(vi)
"Cadre
Controlling Authority" means Home Department (Police Branch) for rank not
below Deputy Superintendent of Police;
(vii)
"Appointing
Authority" means appointing authority as fixed in Bihar executive rules;
(viii)"Service" means Bihar Police
Telecommunications (Wireless) and Technical Services;
(ix)
"DCPW"
means Directorate of Coordination of Police Wireless, Ministry of Home, New
Delhi;
(x)
"DGP"
means officer appointed under Section 5(1) of Bihar Police Act, 2007;
(xi)
"Bihar
Police Radio Organisation" means the organization which is a part of Bihar
Police and which arranges the State-wide transmission of messages pertaining to
Law & Order and Crime prevention and Investigation. Apart from this, if
needed, arranges the transmission of messages as directed by the State
Government or Director General of Police in matters relating to natural
disasters;
(xii)
"Bihar
Police Radio Headquarters" means Bihar Police Radio Organisation office
situated at Patna;
Rule - 3. Organisation of Cadre :-
(A)
This cadre will
be a closed cadre. The hierarchy of this cadre will be as follows :- ?

(B)
The Pay scale
/Pay level of above posts will be same as fixed by State Government from time
to time.
(C)
The post of DIG (Wireless
and Technical Services) would be filled by an officer of the rank of DIG of
Indian Police Service, if the officer working as SP (Wireless) is not
available.
(D)
The Pay scale
/Pay level of above posts will be same as fixed by State Government from time
to time.
(E)
The post of DIG
(Wireless and Technical Services) would be filled by an officer of the rank of
DIG of Indian Police Service, if the officer working as SP (Wireless) is not
available.
Rule - 4. Cadre Strength :-
(i)
Strength of the cadre will be according to
the present strength, however, it will be subject to revision by State
Government from time to time as needed.
(ii)
All the officers of Bihar Police Radio
Organisation, who are already working on the date of enforcement of these rules
will be considered the members of this cadre.
Rule - 5. Appointment, Promotion, Training and Confirmation in the Cadre :-
(I)
Appointment, Promotion, Training and
Confirmation on the post of Dy. SP (Operation) and Dy. SP(Technical)
1.
Fifty percent (50%) posts of the rank of Dy.
SP (Operation) and Dy. SP(Technical) will be filled up by promotion of
confirmed Police Inspector (Operation) and Police Inspector (Technical) and the
remaining fifty percent (50%) posts will be filled through direct recruitment
by the appointing authority on the recommendation of the Commission.
2.
By Direct Recruitment
(A)
Educational Qualification:- Minimum
educational qualification for the posts of Dy. SP (Operation) and Dy.
SP(Technical) will be graduate engineering degree or equivalent passing with
fifty percent (50%) marks in any one subject from the subjects of Electronics
& Communications or Electronics & Tele-communications, or Information
Technology, or Electrical & Electronics, or Instrumentation Engineering
& Communication, or Electrical Engineering (with specialization in
Electronics communications) from recognized university or institution. The
passing marks for members of SC/ST category will be forty five percent (45%).
(B)
Age Limit- The age limit for these posts will
be same as that of directly recruited Dy. SP of General Police force.
(C)
The DGP will send to Government in prescribed
proforma, a requisition mentioning reservation category-wise number of vacant
posts. The commission would organise competitive examination separately or via
combined competitive examination for the appointment of other equivalent posts.
(D)
Selection Process and Methodology - The
examination will be conducted by the commission in three phases. In first
phase, there will be a preliminary examination. This examination would be held
jointly with civil service preliminary examination for Dy. SP of General police
force and other State level posts. The papers for preliminary examination will
be same as those fixed for the Civil Service Examination organized by the
Commission.
For successful candidate in
the preliminary examination, the compulsory papers in the second phase will be
same as Civil Service Examination to be conducted by the Commission for Dy. SP
of General Police force and other State level posts. As optional subject for
these posts, the candidates would select a subject of Engineering graduate
level for the examination from group (A) Electronics and Communications, or (B)
Electronics and Tele-communications, or (C) Information Technology, or (D)
Electrical and Electronics, or (E) Instrumentation Engineering and
Communication, or (F) Electrical Engineering with electronics communication
specialization.
In the third phase, the
successful candidates would be subjected to interview and medical examination.
Upon being successful, the recommendation for appointment to the post of Dy. SP
(Operation) and Dy. SP(Technical) would be sent by Commission to the Government
and accordingly the Government will notify the appointment.
(E)
Training and Seniority - (i) The Dy. SP
(Operation) and Dy. SP(Technical) would be imparted basic police training as
fixed for General Dy. SP rank. Upon completion of this training, they have to
undergo and pass the Advanced Communication Course training as fixed by DCPW.
(ii) The Inter-se-seniority
of Dy. SsP will be based on the same benchmarks which are prescribed by the
State Government for directly recruited Dy. SP in Bihar Police.
(F)
Probation and Confirmation - The probation
period of Dy. SPs will be three years from the date of appointment, during
which they have to pass basic training examination, departmental examination
organized by the Revenue Board, Govt. of Bihar and the Advanced Communication
Course examination of DCPW. After passing all of above examinations, the
appointing authority would consider them for confirmation of their service.
3.
By Promotion
(A)
Fifty percent (50%) posts of Dy. SP
(Operation) and Dy. SP(Technical) would be filled-up by promotion of confirmed
Police Inspector (Operation) and Police Inspector (Technical) on the
recommendation of the commission. The terms and conditions applicable for
promotion shall be same as fixed for promotion from Police Inspector to Dy. SP
of General Police force. Only those Police Inspectors will be eligible for
consideration for promotion who have passed the Advanced Communication Course
training as fixed by DCPW.
(B)
Probation period, confirmation and
departmental examinationThe probation period for Dy. SP appointed by promotion
will be two years. They will be required to pass the Revenue board departmental
examination for confirmation to the post of Dy. SP.
4.
Inter-se-seniority between Directly Appointed
Dy. SP and promoted Dy. SP from Police Inspector Dy. SP promoted from Police
Inspectors will be senior to directly recruited Dy. SP who are appointed in the
same year as the year of formers promotion.
(II)
Promotion to the post of Senior Dy.
SP(Operation) and Senior Dy. SP (Technical)-
The posts of Senior Dy. SP
(Operation) and Senior Dy. SP (Technical) would be filled by promotion of
confirmed Dy. SP (Operation) and Dy. SP (Technical) respectively. This
promotion will be notified by the Government based on the recommendation of
departmental promotion committee formed by the department. The eligibility,
yardstick qualification, benchmarks and procedure for promotion shall be same
as notified by the Government for Senior Dy. SP in Bihar Police.
(III) Promotion
to the post of Additional SP (Wireless)- The post of Additional SP (Wireless)
shall be filled by promotion from Senior Dy. SP (Operation) and Senior Dy.
SP(Technical). A consolidated seniority list of officers holding posts of
Senior Dy. SP(Operation) and Senior Dy. SP (Technical) will be prepared from
the date of promotion on aforesaid posts and on the seniority-cum-merit basis they
would be considered for promotion to the post of Additional SP (Wireless). The
consideration for promotion will be done by the Departmental Promotion
Committee formed by the department for considering promotion of the Bihar
Police Service officials to the post of Additional SP. On the basis of
recommendation of the aforesaid Committee Govt. will notify the promotion.
(IV) Promotion
to the post of SP (Wireless)- The post of SP (Wireless) shall be filled by
promotion from the post of Additional SP (Wireless). The Departmental Promotion
Committee formed for promotion to the post of Staff Officer for Bihar Police
Service would consider and make recommendation for promotion from the post of
Additional SP (Wireless) to the post of SP (Wireless). The government shall
notify promotion on recommendation of the aforesaid Committee.
(V)
Promotion to the post of DIG (Wireless and
Technical Services)- The post of DIG (Wireless and Technical Services) shall be
filled by promotion of the officer working as SP (Wireless). The formation of
Departmental Promotion Committee for promotion to this post will be identical
to the Departmental Promotion Committee fixed for recommending the promotion to
the post of DIG for the IPS cadre and time bound as fixed by the General
Administration Department, Govt. of Bihar shall be applicable in this case. The
Government will notify promotion on the recommendation of Departmental
Promotion Committee. In case the officer working as SP (Wireless) is not
available, this post shall be filled by a DIG rank officer of the Indian Police
Service.
Rule - 6. Reservation :-
The State government
provisions relating to reservation will be applicable to appointment and
promotion to all posts of the cadre.
Rule - 7. Bihar Police Radio Organisation Headquarters :-
The headquarters of Bihar
Police Radio will function at Patna and it will work on the model of District
Police Office (with reserve office). Bihar Police Radio Organisation will
function under Additional Director General (Wireless and Technical Services),
and during his not being posted, function under IG (Wireless and Technical
Services).
Rule - 8. Pay and Allowances :-
The officers of the cadre
will be entitled to the same Pay and Allowances as fixed by the State
Government from time to time.
Rule - 9. Residual Matters :-
All the matters which are
not covered under these rules, or under orders issued under these rules, will
be governed by Bihar Service Code/Rules/Resolution/Bihar Police Manual, as may
be applicable in the State Government for the equivalent posts.
Rule - 10. Interpretation :-
In case of any doubts
relating to any provision of these rules, the Home Department (Police Branch)
will provide the final interpretation/explanation regarding the same.
Rule - 11. Repealing and Amending :-
(i)
The corresponding rules of Bihar Police
Manual, 1978 will be considered accordingly amended after the provisions
contained in Serial No. (I) to (V) of Rule-5 of these rules, relating to direct
recruitment and promotion, come in to effect in Radio Organisation.
(ii)
The Bihar Police Radio (Telecommunications)
Subordinate Officer (Operation) Recruitment, Promotion and Cadre Rules, 1989 as
notified vide Home Department notification no. 368 Dated 06.07.1989 and
corresponding previous orders/ circulars/ directions are hereby repealed.
(iii)
Notwithstanding such repealing, the previous
decisions, issued resolutions/rules/orders in this matter and the actions taken
in the light of them would be deemed to be actions taken under these rules or
under powers provided by these rules; as if these rules were in effect on that
date.4. Cadre Strength :-
(i)
Strength of the cadre will be according to
the present strength, however, it will be subject to revision by State
Government from time to time as needed.
(ii)
All the officers of Bihar Police Radio
Organisation, who are already working on the date of enforcement of these rules
will be considered the members of this cadre.
