POLICE SPECIAL BRANCH SUB-INSPECTOR (GENERAL CLOSED CADRE) RULES, 2024
In exercise of the powers conferred by Sections 55 and 94 of the Bihar Police
Act, 2007 read with the proviso under Article 309 of the Constitution of India,
the Governor of Bihar is pleased to make the following rules for the Bihar
Police Special Branch (Closed Cadre)
Rule - 1. Short title and commencement:
(1)
These rules shall be called
“Bihar Police Special Branch Sub-Inspector (General Closed Cadre) Rules
2024".
(2)
It shall apply to the whole
of the State of Bihar.
(3)
It shall come into force
with immediate effect.
Rule – 2. Definition.
In these rules,
unless the context otherwise requires,
(i)
“Government” means the
Government of Bihar.
(ii)
“Department” means the Home
Department (Police Branch).
(iii)
"Commission" means
the Bihar Police Subordinate Service Commission constituted under Bihar Police
Subordinate Service Commission Act, 2016.
(iv)
"Appointing Authority”
means an officer of the rank of Deputy Inspector General of Police.
(v)
"Cadre" means
Bihar Police Special Branch Sub-Inspector (General Closed Cadre).
Rule - 3. Constitution of Cadre.
(i)
The structure of this cadre
shall be as follows-

(ii)
The sanctioned strength of
various grades of posts of this cadre shall be as such determined by the State
Government from time to time. The Cadre strength can be revised from time to
time by the state Government by way of post creation or post abolition.
(iii)
The pay scale of different
categories of posts of this cadre shall be the same as notified by the State
Government from time to time with respect to this Cadre. In the light of
specific nature of work of the members of this cadre, the decision to give them
other incentives besides salary could be taken by the Government.
(iv)
Rules of Bihar Police Manual
1978 (as amended), Bihar Police Act, 2007, the orders issued by the Government,
orders/instructions issued at the level of Police Headquarters from time to time
shall be applicable to the members of this Cadre at par with the other Bihar
Police officers.
(v)
According to Section-3 of
Bihar Police Act, 2007, this cadre shall be considered as part of Bihar Police
and discipline of force shall be applicable at par with other Bihar Police
officers.
(vi)
The appointment of employees
of this cadre shall be for special Branch (Closed cadre) only.
(vii)
In addition to the posts
allotted for the closed cadre in the special branch,
posting/deputation/transfer of officers/personnel from other units/cadres of
Bihar Police can be done
Rule - 4.
(1)
90 percent of the total
strength of the posts of Sub-Inspector of this Cadre shall be filled up by
direct recruitment based on the recommendation of the Commission and 10 percent
of the posts shall be filled by promotion of Assistant Sub-Inspector from the
Bihar Police Special Branch Constable (General Closed Cadre),

The officers of this cadre
shall wear uniform as provided in Bihar Police Manual, 1978 and they shall be
recruited only for the Special Branch.
(3)
The work of the Special
Branch is highly confidential and is concerned with exchange of intelligence,
therefore, no Union or Association of officers / personnel of this cadre can
either be formed, nor can they participate in the election of any other Police
Association or Union, or involve themselves in any of the activities of any
other Police Association or Union.
(4)
On the basis of status of
each category of this cadre as on the 1* of April of every year, the Additional
Director General of Police, Special Branch shall get a reservation calculation
of number of vacancies of Sub-Inspectors of this cadre calculated category wise
as per rules laid down and after approval from the Director General of Police,
Bihar, shall take necessary action for the process of recruitment.
Rule - 5. Direct Recruitment in the Cadre.
(i)
The selection of candidates
for appointment to the posts of direct recruit Sub Inspector of this closed
cadre shall be done separately by Bihar Police Subordinate Service Commission
through a competitive examination. A requisition shall be sent by the Director
General of Police, Bihar to the Commission in the prescribed pro forma in which
the number of reservation category wise vacant posts shall be mentioned. The
Bihar Police Subordinate Service Commission shall set the question paper,
conduct the written examination, appoint expert examiners to check the answer
sheets and shall recommend the successful candidates for the appointment.
(ii)
Educational Qualification Minimum
educational qualification for recruitment to the basic post of Sub-Inspector
shall be graduation or equivalent degree.
(iii)
Age The criterion of age for
appointment to the post of Sub-Inspector in this Cadre shall be the same as
prescribed for the post of Sub-Inspector in Bihar Police from time to time.
(iv)
Based on the requisition
received (from the Director General of Police, Bihar) the Commission shall
advertise for the vacancies through widely circulated newspapers and through
its official website. The candidates shall have to strictly abide by the
instructions and conditions given in the advertisement. Such examination fee,
as fixed by the Commission, may be charged from the candidates.
(v)
Candidates shall submit
their applications in the prescribed form as per terms and conditions that may
be laid down in the advertisement so published by the Commission.
(vi)
Written Examination- The
Written Examination shall be conducted in two phases as Preliminary and Main
examination respectively.
a.
preliminary examination.
In the first phase, a
preliminary examination shall be conducted, all questions of which shall be
objective with multiple options. There shall be one question paper carrying 200
marks in preliminary examination in which total number of questions asked shall
be 100 and duration of the examination shall be of two hours. For each correct
answer 2 marks shall be awarded.
In the said question
paper, questions related to English, General Knowledge, Hindi language
knowledge, reasoning and current affairs shall be asked (Candidates obtaining
less than thirty percent marks shall not be considered for selection for the
main examination).
On the basis of marks
obtained in the preliminary examination, a maximum of ten times the number of
vacancies, the candidates shall be selected reservation category wise for the
main examination. But in case of nonavailability of sufficient number of
qualified candidates, the said ratio (uniform in all categories) shall
proportionately be reduced by the Commission.
b.
Main examination.
Candidates declared
successful in preliminary examination conducted in first phase shall be given
an opportunity to appear in the main examination. There shall be two papers in
the main examination. The first paper shall contain 200 objective questions
with multiple options to be answered. in allotted time of 180 minutes. One mark
will be awarded for each correct answer whereas 0.25 mark shall be deducted for
each wrong answer. The second paper shall be for 50 marks and time allotted
shall be 60 minutes. The subject and type of examination will be as per table
hereunder. The answer sheet of the first question paper shall be in duplicate,
one copy of which shall be kept safe with the commission and one copy shall be
given to the candidate. It is mandatory to score at least 30 percent in both
papers. The selection of candidates, thrice the number of vacancies shall be
done for Physical efficiency test.

(vii)
Physical Standards Physical
standards of the candidates shall be as per the criteria prescribed for
recruitment of the Sub-Inspector of Police of Bihar Police organization with
regard to height, chest and weight. The candidates who are not found eligible as
per the prescribed criteria shall be considered unsuccessful. No marks shall be
prescribed for physical standards.
(viii)
(viii) Qualification The
minimum qualifying marks for successful candidates In the final merit list
prepared reservation category wise on the basis of the final written
examination, shall be the same as prescribed from time to time by General
Administration Department.
(ix)
Preparation of merit list.
a.
The merit list of finally
successful candidates shall be prepared reservation category wise on the basis
of marks obtained in the main written examination.
b.
In the event of two or more
successful candidates obtaining equal marks in the written examination, their
rank in the merit list shall be decided on the basis of seniority of age i.e.
the candidate senior in age shall be given higher position in the merit list.
In case of two or more candidates having the same marks and having the same
date of birth, their rank in the merit list shall be determined on the basis of
their educational qualification, that is, the candidate with higher educational
qualification shall be placed above in the merit list. Despite this, if more
than one candidate has same marks, same date of birth and same educational
qualification, then the seniority of such candidates shall be determined
according to their names in Hindi Alphabetical order as mentioned in their 10th
Board Examination Certificate.
c.
The Commission shall prepare
a list of the candidates who have obtained the minimum qualifying marks based
on merit in descending order and as per the requisition received and recommend
the names of the candidates’ reservation category wise in the descending order
of merit.
(x)
Medical Examination,
Character and Antecedent verification.
a.
Character and antecedents of
the candidates shall be verified before appointment to the post of police
Sub-Inspector (Closed Cadre). On receipt of an adverse report or in case of
concealment of facts by the candidates, concerned candidates shall be declared
disqualified for appointment.
b.
[As provided in Rule 658
(iv) of Bihar Police Manual Rule] the candidate must be free from such disease,
constitutional affliction or bodily infirmity which renders him/her unfit or
likely to make him/her unfit for the discharge of assigned duties.
Comments-
(i)
Medical examination of all
the selected candidates shall be done before appointment. Vision perception,
color blindness, hearing power, stuttering, flatfeet, and knocked-knee etc.
shall also be examined. It shall be mandatory for the selected candidates to be
found fit in the medical examination for appointment.
(ii)
A defect such as stuttering,
or stammering shall render the candidate ineligible for selection.
(iii)
A candidate shall be
considered ineligible for appointment if there is any criminal case pending against
him/her in any court of law or on being convicted by any court of law.
(xi)
Appointment of
Sub-Inspectors of Closed Cadre- The appointing authority for appointment of the
candidates recommended by the Commission for the post of Police Sub-Inspector,
shall be an officer of the rank of Deputy Inspector General of police of
Special Branch. If there is vacancy in the rank of DIG Special Branch, the
Director General of Police, Bihar, will nominate any other DIG rank officer as
the appointing authority.
(xii)
Training.
(A)
Basic training of directly
recruited Sub-Inspectors of Closed Cadre shall be of 270 working days, out of
which 60 days training shall be about different aspects of Police Organization
and physical ability and 150 days training shall be related to intelligence. 60
days training shall be given as internship by coordinating with Intelligence
agencies.
(B)
The Training division of
Bihar Police shall prepare the syllabus for training in coordination with
various Intelligence Agencies and get the same approved by the Director General
of Police Bihar before starting the training.
(xiii)
Departmental Examination- It
shall be mandatory for all the newly recruited police Sub-Inspectors from
direct recruitment of the Cadre to pass Hindi Noting and Drafting Test
conducted by Cabinet Secretariat (Official Language Department), Government of
Bihar and Computer Efficiency Test conducted by NIELIT. Second and further
increment of salary shall be given only after passing the said examination.
(xiv) Period
of Probation and Confirmation:
(a)
Newly appointed Police
Sub-Inspector (Closed Cadre) shall be on probation from the date of
appointment. The period of probation shall be of two years. The period of
probation may be extended for one year if the work is not found satisfactory.
If a probationer is found not fit for service, at any point of time during
probation period, he/she shall be terminated from the service.
(b)
Services of Police
Sub-Inspectors of this cadre shall be confirmed on the basis of satisfactory
service after they complete their basic training, period of probation and they
pass the departmental examination.
Rule - 6. Appointment by promotion in the Cadre.
10 percent of the
total cadre force of police Sub-Inspector of the cadre shall be filled up by
promotion of Assistant Sub-Inspector of Police of Bihar Special Branch
Constable (Closed Cadre) on the basis of seniority-cum-merit and the Provisions
of reservation and time period as notified by the General Administration
Department shall be applicable. For this purpose, Departmental Promotion
Committee shall be constituted by the department by a separate order.
Rule - 7. Seniority.
The inter- seniority
of the Sub-Inspectors (Closed Cadre) shall be determined according to the
pro-rata addition of marks so obtained in the main written examination
conducted by the Commission and marks obtained in basic training.
The inter- seniority
of Sub-Inspectors of Police appointed by promotion in Police Sub-Inspector
(Closed Cadre) shall be the same as their seniority is determined on the post
of Assistant Sub-Inspectors of Police.
A Sub-Inspector of
Police appointed by promotion in the Cadre in any calendar year shall be senior
to the Sub-Inspector of Police appointed. by direct recruitment in that year.
Rule - 8. Reservation.
(i)
The provisions regarding
reservation for appointment and promotion to the posts of Special Branch
(Closed Cadre), as determined by the State Government from time to time, shall
be applicable.
Rule - 9. Departmental promotion.
(i)
Police Sub-Inspector in
Special Branch Closed Cadre could be promoted to a higher post in the hierarchy
on the basis of seniority-cum-merit, provided the revised time period as
determined time to time by the General Administration Department is completed.
(ii)
Promotion shall be due
according to seniority-cum-merit criteria, which shall be considered on the
recommendation of Departmental Promotion Committee. Eligibility criteria for
promotion shall include confidential character remarks, departmental
examination etc.
Rule - 10. Departmental Promotion Committee.
(i)
Departmental Promotion
Committee shall be constituted by the department by a separate order of
department.
(ii)
Promotion can be considered
on the completion of the time period on the basis of pay scale so decided by
the Government (General Administration Department) from time to time.
(iii)
It shall take time to fill
the vacancies by promotion in the initial years. Therefore, during the
transition period, which will be for a maximum of six years, these posts shall
be filled up by General Police Sub-Inspector of Bihar Police.
Rule - 11, Residuary matters.
Matters. which are
not covered by these rules or any order issued hereunder, such matters shall be
governed by the provisions of Bihar Service Code / Rules / Resolution / Bihar
Police Manual / Bihar Police Act 2007, whichever is applicable to the
equivalent post in the State Government.
Rule - 12. Interpretation.
If any doubt arises
with respect to interpretation of any provision of these rules, the
interpretation made by Home Department (Police Branch) in consultation with Law
Department shall be final.
