THE ANDHRA PRADESH (TELANGANA AREA) JAGIRS
(COMMUTATION) RULES, 1962
PREAMBLE
In exercise of the
powers conferred by Section 11 of the Andhra Pradesh (Telangana Area) Jagirs
(Commutation) Regulation, 1359F. (Regulation XXV of 1359F) the Governor of
Andhra Pradesh hereby makes the following rules prescribing the procedure for
the continuance of the payment of commutation sum in certain cases under
Section 10-A of the said Regulation:
Rule - 1.
These rules may be
called the Andhra Pradesh (Telangana Area) Jagirs (Commutation) Rules, 1962.
Rule - 2.In these rules, unless the context otherwise requires,--
(a) 'grant' means the
amount fixed under Section 10-A of the Regulation;
(b) the 'Regulation'
means the Andhra Pradesh (Telangana Area) Jagirs (Commutation) Regulation,
1359F. (Regulation XXV of 1359F.);
(c) 'Section' means a
section of the Regulation;
(d) 'Special
Communication Payment Order' means the order specifying the communication sum
payable under Section 10-A;
(e) Words and expressions
used but not defined in these rules shall have the respective meanings assigned
to them in the Regulation.
Rule - 3.
(1) Every Jagirdar,
Hissedar or Guzarayab who wishes to avail of the benefit conferred by Section
10-A shall make an application to the Jagir Administrator in the Form appended
to these rules.
(2) [1]The application
referred to sub-rule (1) shall be submitted to the jagir Administrator before
the 30th September, 1965 Applications submitted after the said date will not
normally be accepted. However, the jagir Administrator and the Government shall
be competent to condone the delays of the periods specified below in submission
of such claims for good and sufficient reasons.--
(i) The Jagir
Administrator upto three months from the last date specified in this sub-rule;
and
(ii) The Government in the
Revenue Department, beyond the said period of three months from such
date".
Rule - 4.
(1) Where the age of the
jagirdar, Hissedar or Guzarayab, claiming the benefit under Section 10-A was
not less than 60 years on the 1st April, 1960 that 1. Sub-rule (2) added by

person's age as per
the date of birth as disclosed on the Commutation Payment Order shall be
admitted. If the Commutation Payment Order does not disclose the date of birth,
the correct age shall be the age as per the date of birth, as shown in his High
School Leaving Certificate (Matriculation).
(2) The Jagirdar,
Hissedar or Guzarayab concerned shall produce the original or a true copy or an
extract of the School record, indicating the date of birth, duly attested by
Gazetted Officer or a Magistrate with his Office Seal affixed thereon;
Provided that in case
there is no School record available for verification of the date of birth, in
the case of a person residing within this State, the age certificate as issued
by a Civil Surgeon in service, under Government and in the case of person
residing outside the State, the age certificates as issued by a Civil Surgeon
of the district, where the person resides duly attested by the District
Magistrate concerned, may be accepted.
Rule - 5.
Where the Jagirdar,
Hissedar or Guazrayab, claiming the benefit under Section 10-Ais a person
getting service pension 1[..................] such person shall not be entitled
to claim the grant of commutation sum under Section 10-A.
Rule - [2][5-A.
In case a Jagirdar,
Hissedar or Guzarayab claiming the benefit under Section 10-A is a person
getting a pension other than service pension he/shall be entitled to claim the
payment of Rs. 25/- (Rupees Twenty Five) or the commutation sum to which he/she
is entitled to for the year ending on the first April, 1960, whichever is less
after deduction of the amount of pension which he/she is already drawing.
Rule - 6.
If a Jagirdar,
Hissedar or Guzarayab holds more than one Commutation Payment Order indicating
different dates of birth according to one or more of which the age was less
than 60 years on the 1st April, 1960, and if payment on account of them has
ceased, the grant shall not be sanctioned in such cases unless evidence of
correct age is produced in the manner provided in rule 4.
Rule - 7.
Where a claimant to
the benefit under Section 10A is less than 60 years of age on the 1st April,
1960, and claims the benefit on any of the grounds specified in column (1) of
the Table below, such claimant shall produce the documents mentioned against
the corresponding item in column (2) thereof.

(i) In the case of a male or an
unmarried woman, if the person is incapable of earning a livelihood and on
account of being blind, deaf, dumb and mute, mentally deranged, crippled or
paralytic. |
(a) in the case of a male, a
certificate issued by a Civil Surgeon in service under the Government showing
the nature and extent of the disability; and (b) In the case of an unmarried
woman.-- (i) a certificate issued by a Civil
Surgeon in service under the Government showing the nature and extent of the
disability; and |

(ii) a certificate issued by any
Gazetted Officer showing that she is not married. |
(ii) In the case of a widow |
(i) a certificate showing the date of
death of her husband, issued by a statutory authority, like a Municipal
Council in case the death occurred in a town or city and in other cases a
certificate issued by the Tahsildar of the Tahsil within whose jurisdiction
the death took place; and |

(ii) a certificate showing that the
widow has not remarried, issued by the Tahsildar, concerned if she is living
in a village, and in other cases by any Gazetted Officer over his official
seal. |
(iii) Where the person is minor (a) in the case of a male, if such
commutation sum is his only source of income. |
(i) An attested extract showing the
date of birth from the Register of Births maintained by a statutory authority
like a Municipal Council or any other competent authority under the
Government; or a certificate issued by the Head-master of the School where
the claimant may be studying showing the date of birth as entered in the
School Register at the time of admission; or |

If either of the certificate
mentioned above cannot be produced, a certificate of age issued by a Civil
Surgeon in service under the Government; and |
|
(ii) a certificate showing that the
commutation was his only source of income, issued by the Tahsildar of the
concerned Tahsil, if the minor is living in village and in other cases by any |
(b) In the case of female |
Gazetted Officer attested over his
official seal. (i) An attested extract showing the
date of birth from the Register of Births, maintained by a Municipal Council
or any other competent authority under the Government; or a certificate
issued by the Head-master of the School, where the claimant may be studying
showing the date of birth as entered in the School Register at the time of
admission; or |

If either of the certificates
mentioned above, cannot be produced, a certificate of age issued by a Civil
Surgeon in service under the Government; and |
|
(ii) A certificate showing that she
is not married, issued by the Tahsildar concerned, if she is living in a
Village and in other cases, by any Gazetted Officer attested over his
official seal. |
Rule - 8.
If a Jagirdar,
Hissedar or Guzarayab, eligible for the benefit under Section 10-A was in
receipt of commutation sum from more than one khata, a sum equivalent to the
aggregate of the commutation sums, which were payable to him for the year
ending on the 31st March, 1960 or Rs. 25 per month, whichever is less, shall be
admissible to him.
Rule - 9.
The Special
Commutation Payment will be paid in monthly instalments.
Rule - 10.
After receipt of the
applications with the certificates as required under Rule 4 or 7, from the
Jagirdars, Hissedars and Guzarayabs who are eligible for the payment of the
grant, the Jagir Administrator shall scruitnise the petitions with reference to
the certificate submitted and the commutation awards passed by him and after
being satisfied of the claim shall recommend to the Government for the sanction
of the payment in favour of the claimants. After receipt of sanction from the
Government the same shall be forwarded to the Accountant-General by the Jagir
Administrator. The Accountant-General thereon shall issue the Special
Commutation Payment Order in favour of the claimant, in terms of the Government
sanction, on the Government Treasury Offices, wherefrom the claimant wishes to
draw the amount of the Special Commutation Payment Order.
Rule - 11.
The payment of the grant
in favour of the claimants will be effective from the 1st April, 1960 and it
shall be paid on or after the 1st of every succeeding month, with arrears, if
any.
