1. Heard Mr. Tushar Mehta, learned Additional Solicitor General for Union of India and Mr. Kapil Sibal, learned senior counsel and Dr. Abhishek Manu Singhvi, learned senior counsel for the respondent in S.L.P.(Crl.)No. (Diary No.9360/18).

2. Having heard learned counsel for the appearing parties, we think it appropriate to transfer W.P.(Crl.)No.363 of 2018 along with Crl.M.A.No.2151 of 2018 filed in the said writ petition and pending before the High Court of Delhi, to this Court. We are directing so, as there are conflicting views of various High Courts.

3. Registry is directed to intimate the Registry of the High Court of Delhi to call for the papers of the abovementioned case(s) and list the same at 2:00 p.m. on 26.03.2018 along with the present matters.

4. That apart, W.P.(Crl.)No.739 of 2018 along with Crl.M.A.No.4539 of 2018 shall also stand transferred to this Court and papers be called for and the writ petition be listed on the abovementioned date.

5. The interim relief granted by the High Court in W.P. (Crl.)No.739 of 2018 shall remain in force till the next date of hearing, i.e., 26.03.2018.

6. Mr. Mehta, very fairly submitted that he will not argue the matter for more than an hour. Mr. Kapil Sibal, learned senior counsel and Dr. A.M. Singhvi, learned senior counsel appearing for the respondent have also stated that both of them may not take more than an hour and fifteen minutes.

7. We appreciate the said submission at the Bar.
