JAY SENGUPTA, J:

1. This is an application praying for direction upon the respondents to allow the petitioner to appear/sit in the semester examination of Statistics (H) scheduled to be held on and from 20.02.2025 or any dates and to take necessary steps to complete registration process and issue registration card to the petitioner for such purpose.

Learned counsel for the petitioner submits that the petitioner satisfied all the criteria for getting admission to the course of B.Sc with Statistics (H) at the Asutosh College under the University of Calcutta. But, the University authorities are not granting registration to the petitioner. The last date of registration was on 08.02.2025. The examinations are scheduled to be held on 20.02.2025 onwards.

Learned counsel for the respondent College submits that according to his client, the petitioner does qualify for getting admission to the course because she did not have Statistics as a subject in her qualifying course and she obtained 50% marks in aggregate. That is the requirement as per Clause 5(a)(iii) of the Admission Regulations of the University of Calcutta.

4. Learned counsel for the University of Calcutta denies the allegations and submits that the petitioner clearly does not satisfy 5(a)(iii) and 5(a)(ii) of the said Regulations. If she is permitted to take the benefit of 5(a)(iii), the date of registration has to be extended.

From the Admission Regulations for the course of B.Sc in the year 2023 under the Calcutta University, it is abundantly clear that a student taking up a major course in a subject must have obtained 50% marks in the aggregate when the student has not studied the subject in his/her previous qualifying examination provided all other clauses are satisfied, as one of the options. It appears that the petitioner satisfies these criteria.

6. Therefore, there should be no reason for the respondent authorities not to grant registration to the petitioner for the purpose of sitting in the semester examination.

In view of the above, let the respondent authorities, especially the respondent No.3 permit the petitioner to take registration upon compliance of necessary formalities and issue a registration certificate to the petitioner to that effect at the earliest, preferably within 17.02.2025. Necessary admit card shall also be issued for the ensuing examination by 18.02.2025, so that the petitioner can sit in the said examinations which are scheduled to commence on 20.02.2025.

8. With these observations and directions, the writ petition is disposed of.

9. As affidavits were not called for, the allegations made are deemed not to have been admitted.

10. Parties shall act on a server copy of this order duly downloaded from the official website of this Court.
