1. Heard Mohd. Jamshed Khan, learned counsel for the applicant, learned A.G.A. for the State and perused the papers on record.
2. This application has been filed by applicant seeking anticipatory bail in Case Crime No.138 of 2022, under sections3/5/8 Cow Slaughter Act, Police Station- Bhopa, DistrictMuzaffar Nagar.

As per prosecution case, on the basis of confidential information received by the local police that a cow is being slaughtered in the house of one Sajid; the police party raided the place and found one Mehmood packing beef in plastic bags after slaughtering a calf; a severed head and other parts of the body were recovered from the spot; the person arrested disclosed the name of one Sajid and his wife as being the persons involved in slaughtering of calf.

It is contended on behalf of the applicant that she is a woman and she is innocent; she had no role to play in the act of slaughtering the calf and that she has been entangled in this case because she happens to be wife of co-accused Sajid; she has no criminal history and there is no chance of her fleeing from the process of law.
5. The application for anticipatory bail is opposed by learned A.G.A. for the State and it is contended that the pieces of beef were found in the fridge kept in the house of the present applicant. It is conceded that she has no criminal history and that the investigation is still pending against her.
6. In view of the above, I find it a fit case to give benefit of anticipatory bail to the applicant, hence, the anticipatory bail application of the applicant is allowed.
7. Let the applicant Smt. Shahnaz, involved in the aforesaid case crime number be released on anticipatory bail till submission of charge-sheet on furnishing personal bond of Rs. 1,00,000/- each and single surety of the same amount before the court concerned subject to the conditions as below:-
(i) that the applicant shall make herself available for interrogation by a police officer as and when required;
(ii) that the applicant shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer or tamper with the evidence;
(iii) that the applicant shall not leave India without previous permission of the court;
(iv) that the applicant shall not tamper with the evidence during the trial;
(v) that the applicant shall not pressurize/intimidate the prosecution witness;
(vi) that the applicant shall appear before the trial court on each date fixed unless personal presence is exempted.
8. In case of breach of any of the above conditions, the court below shall have the liberty to cancel the bail granted to the applicant.
9. It is made clear that observations made in granting anticipatory bail to the applicant shall not in any way affect the learned trial Judge in forming his independent opinion based on the testimony of the witnesses.
