ANTICIPATORY BAIL APPLICATION NO. 1209 of 2024 | 27-02-2025

1. The present Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed for grant of Anticipatory Bail under Sections 420, 467, 468, 471 of the Indian Penal Code, 1860 in Case Crime No.337 of 2024, registered at Police Station Doiwala, District Dehradun.

2. As per the First Information Report, the applicant forged the documents to procure electricity and water connection.

3. Heard Mr. Lalit Sharma, learned counsel for the applicant, Mr. Pradeep Lohani, learned Brief Holder for the State and Mr. B.S. Negi, learned counsel for the informant.

4. Mr. Lalit Sharma, Advocate has contended that Smt. Renu Singh, aged about 71 years, the aunt (Bua) of the informant, has been falsely implicated in the present matter, because there are civil disputes pending between the applicant and the informant. It is a property dispute. Applicant is a permanent resident of District Dehradun, therefore, there is no chance of her absconding, and, she is cooperating with’ the investigation. On 04.12.2024, the co-ordinate Bench has granted interim bail to the applicant.

5. Mr. B.S. Negi, Advocate has opposed the anticipatory bail application. However, he has conceded that there are property disputes between the parties.

6. Mr. Pradeep Lohani, Brief Holder of the State, has opposed the anticipatory bail application. However, he has submitted on instructions that the applicant is cooperating with the investigation.

7. Personal liberty under Article 21 of the Constitution of India is very precious fundamental right and it should be curtailed only when it becomes imperative according to the peculiar facts and circumstances of the case.

Having heard the submissions of learned counsel for the parties and keeping in view of the facts and circumstances of the case, without commenting on the merits of the case, the present application, filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is allowed and order dated 04.12.2024, granting interim bail to the applicant, is made absolute. It is directed that in the event of arrest of the applicant-Smt. Renu Singh, she shall be released on anticipatory bail on executing a personal bond of Rs. 30,000/- and two reliable sureties, each of the like amount to the satisfaction of the Arresting Officer, subject to the following conditions: -

(i) Applicant shall cooperate with the Investigating Agency and she shall make herself available for interrogation by a_ police officer as and when required;

(ii) If the charge-sheet is filed, the applicant shall attend the trial court regularly and she shall not seek any unnecessary adjournment;

(iii) Applicant shall not directly or indirectly make any inducement, threat or promise to any person, acquainted with the facts of this case.

(iv) Applicant shall not leave the country without the previous permission of the trial court.

9. It is made clear that if the applicant misuses or violates any of the conditions, imposed upon her, the concerned authority will be free to move the Court for cancellation of the anticipatory bail.
