1. The petitioner is seeking anticipatory bail in FIR No. 433 dated 07.08.2021, under Sections 120-B, 420, 467, 468 and 471 of the Indian Penal Code, 1860 (‘IPC’ - for short) (Section 201 IPC added later on), besides Section 66 of the IT Act, 2000, registered at Police Station Kaithal City, District Kaithal.
2. Learned counsel for the petitioner contends that the petitioner has been arraigned as an accused on the statement of co-accused and besides the statement of co-accused there is no material to connect the petitioner with the alleged commission of offence.
3. Issue notice to the respondent.
4. At the asking of the Court, Mr. Deepak Bhardwaj, DAG, Haryana, accepts notice on behalf of the respondent. He contends that the petitioner has been arraigned as an accused on the statement of co-accused and there are call details indicating that the petitioner was having conversation with co-accused Raj Kumar prior to the conduct of the examination. The petitioner had also travelled from Jammu to Delhi by air on 05.08.2021.

6. The allegations against the petitioner are that he along with co-accused was allegedly involved in the leakage of question paper and answer keys for recruitment of constable to the Haryana Police. The petitioner was allegedly in touch with co-accused, as there are call details. In view of serious allegations against the petitioner, I do not deem it to be a fit case to grant the concession of anticipatory bail to the petitioner.
7. Consequently, the petition stands dismissed.
8. However, it is clarified that nothing which has been observed here-in-above shall be deemed to have any bearing on the merits of the case.
