FAKHRUDDIN, J.

(1.) Heard. Counsel for the applicant submits that this court has already granted bail vide order dated 23/8/2001, on his furnishing a cash bail in the sum of Rs. 25.000/-. a personal bond in the sum of Rs. 25.000/- with two local sureties in the like amount to the satisfaction of the C.J.M., Durg. Counsel for the applicant prays for modification of the said order and relied upon the judgment delivered in the case of Keshav Narayan Banerjee v. State of Bihar, wherein it has been held that direction to furnish security for Rs. 1,00.000/- in cash or in fixed deposit in nationalised bank with two sureties residing in the State for like amount amounts to denial a of bail itself.

Having considered the facts and circumstances of the case and material on record, it is directed that applicant be released on bail on his furnishing a personal bond in the sum of Rs. 10.000/- with two sureties of Rs. 5.000/- each to the satisfaction of C.J.M. concerned for his appearance before the said court or as and where so directed.

(3.) It is made clear that personal bond shall contain photograph details of movable and immovable property belonging to the applicant and crime number of the police station. The application is disposed of. Certified photocopy as per rules. Petition allowed.
