1. The convict-petitioner Likhmaram has filed the instant parole writ petition seeking to assail the adverse recommendations dated 21.12.2020 drawn in the meeting of the District Parole Advisory Committee, Jalore whereby the application for first parole filed on his behalf has been rejected on the ground that he has been convicted for murder of his son and if he is released on parole, there is imminent risk to the petitioner’s safety. The apprehension of breach of peace and unrest was also a reason assigned in the adverse recommendations to deny first parole to the convictpetitioner.

Pursuant to the direction given by this Court on 12.07.2021, a para-legal volunteer visited the convict-petitioner at the Central Jail, Jodhpur and made inquiries from him as to where, he would go in the event of being released on first parole and also, the names of the persons who would stand surety for him. The report of the Para-Legal Volunteer is placed on record as per which, upon being released on first parole, the convict-petitioner is desirous of going to meet his two daughters Smt.Dami Devi and Smt. Namu Devi, residents of Nimali Nadi, Samdari, Balotra. So far as surety is concerned, the convict-petitioner stated that he is desirous of being released on parole on his personal bond only and no one was named by him who can give surety for his release on parole.
3. The convict-petitioner is 69 years old and has been serving life imprisonment at the Central Jail, Jodhpur. As per the nominal roll, till 30.06.2021, the petitioner had already served sentence of 7 years and 25 days.
4. Thus, considering the overall facts and circumstances of the case and looking to the old age of the convict-petitioner and in order to give the convict-petitioner one reasonable opportunity of reformation and reintegration into the society, we are inclined to extend indulgence of parole to him.

Accordingly, the adverse recommendation drawn by the District Parole Advisory Committee, Jalore in its meeting held on 21.12.2020 is set aside qua the convict-petitioner and it is ordered that the convict Likhmaram S/o Shri Chimnaram shall be released on first parole of twenty days upon his furnishing a personal bond in the sum of Rs.1,00,000/- to the satisfaction of Superintendent, Central Jail, Jodhpur on the usual terms and conditions. The Superintendent, Central Jail, Jodhpur shall be at liberty to impose other adequate and reasonable conditions to ensure return of the convict to the custody after availing the parole. The term of parole shall be computed from the date of his actual release.
6. The parole writ petition is allowed in these terms.
