On 15.01.2021, the following order had been passed by this court:-

“Case heard by video conferencing.

By this petition, filed under the provisions of Section 439 of the Cr.P.C., the petitioner seeks the concession of ‘regular bail’, upon FIR no.83, dated 19.02.2020, having been registered at Police Station Rania, District Sirsa, alleging therein the commission of offences punishable under Sections 22C/61/85 of the NDPS Act, 1985.

Learned counsel for the petitioner submits that the petitioner having been in custody for more than 1 year, with the trial still not concluded, he deserves to be admitted to bail.

Learned State counsel submits that a total quantity of 5000 tablets containing ‘Tramadol’ weighing about 3 k.g. having been recovered from the petitioner, he cannot be admitted to bail in the light of the judgment of the Supreme Court in Satpal Singh v. State of Punjab 2018(5) RCR (Crl.) 152.

Learned counsel for the petitioner seeks time to distinguish that judgment.

Adjourned to 28.01.2021.”

Today, learned counsel for the petitioner seeks to withdraw this petition at this stage.

Consequently dismissed, as having been withdrawn.
