S.B. Criminal Miscellaneous Bail Application No. 14817/2021 | 11-11-2021

1. Learned counsel for the petitioner does not want to press this bail application on behalf of Petitioner No.1 Kanti Lal S/o Hakra.

2. The bail application of petitioner No.1 Kanti Lal S/o Harka is dismissed as not pressed.

3. The petitioner no.2 has been arrested in connection with FIR No.124/2021 of Police Station Phalisiya Distt. Udaipur for the offence punishable under Sections 307, 323, 341 and 34 of the IPC. He has preferred this bail application under Section 439 Cr.P.C.

4. Counsel for the petitioner submits that so far as the allegations levelled against the petitioner Kamlesh is concerned, as per injury report of Shanti Lal, it is clear that he has inflicted simple injuries upon him. The accused-petitioner is in judicial custody and the trial of the case will take sufficient long time to be concluded. Therefore, the benefit of bail should be granted to the accused-petitioner.

5. Learned Public Prosecutor has opposed the bail application.

6. Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the accused petitioner no.2 under Section 439 Cr.P.C.

7. Accordingly, the bail application of accused petitioner Kamlesh filed under Sec.439 Cr.P.C. is allowed and it is directed that petitioner Kamlesh S/o Kanti Lal shall be released on bail in connection with FIR No.124/2021 of Police Station Phalisiya Distt. Udaipur provided he executes a personal bond in a sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
