Suo Moto Writ Petition (Criminal) No. 122 Of 2011 | 20-06-2011

1. By order dated 6th June, 2-011, vacation bench of this Court directed the Home Secretary, Union of India, the Chief Secretary, Govt. of NCT of Delhi and Commissioner of Delhi Police, New Delhi to file personal affidavits explaining the conduct of the police authorities and circumstances in which powers were asserted against large number of people who had gathered at Ramlila Maidan.

2. Pursuant to the said notice, third respondent-Commissioner of Police, New Delhi has filed counter affidavit. The second respondent-the Chief Secretary, Govt. of NCT of Delhi has also filed counter affidavit stating that during the relevant time, he was out of India. The first respondent-Union of India is yet to submit its stand.

3. On going through the stand taken by the third respondent, we intend to hear Aacharya Virendra Vikram Bharat Swabhiman Trust, Delhi Prakesh, Arya Samaj, Greater Kailash-I, New Delhi. The Trust is made as respondent No. 4. Accordingly, we issue notice to the afore-mentioned Trust. Copy of the counter affidavit filed on behalf of respondent No. 3 without the sealed covers (annexures) shall also be enclosed with the said notice.

4. List on 11th July, 2011.
