1. The hearing of the case was held through video conferencing on account of restricted functioning of the Courts.

2. This is the second petition for grant of bail, pending trial, in a criminal case arising from FIR No.271, dated 30.11.2018, registered under Section 22 of the NDPS Act, 1985, at Police Station Lehra, District Sangrur.

3. The first petition was dismissed on 14.11.2019 with the following order:-

“Petitioner prays for grant of regular bail in FIR No.271 dated 30.11.2018 registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, at Police Station Lehra, District Sangrur.

As per case of the prosecution, petitioner was found in conscious possession of 125 bottles/vials 100 ml each of Wincirex containing intoxicating syrup and 700 intoxicating tablets make Carisoma.

Learned counsel for the State, on instructions from HC Gurmail Ram, submits that the petitioner is involved in two more cases under NDPS Act and two under the Excise Act and one with regard to theft.

On the other hand, learned counsel for the petitioner submits that the petitioner has been acquitted in one of the case under NDPS Act.

Be that as it may. Keeping in view the facts of the case, this Court is not inclined to grant concession of bail to the petitioner.

Accordingly, the present petition is dismissed.

However, since the petitioner is in custody, learned trial Court is requested to expedite the trial."

4. The learned counsel representing the petitioner contends that the petitioner stands acquitted in one case under the NDPS Act. He, hence, contends that petitioner who has suffered incarceration for approximately 2 years and 7 months should be granted bail.

5. The learned counsel for the petitioner admits that the petitioner is still facing prosecution in as many as 5 cases including this one.

6. Hence, no ground to grant concession of bail is made out.

7. Dismissed.

8. All the pending miscellaneous applications, if any, are also disposed of.
