1. Following orders were passed in the matter on 7.2.2025:-
"It is urged that an unauthorized embankment has been constructed, which has resulted in grave difficulties for the residents, inasmuch as the water is entering into their fields and houses.
In the facts of the case, we direct the learned Standing Counsel to obtain instructions from respondent no.2, in respect of the grievance raised.
Post as fresh on 20.02.2025."

Learned Standing Counsel has obtained instructions, according to which a check dam has already been constructed in larger public interest and that it is not causing any hindrance or hazard for the residents. It is also stated that there is no problem of back flow of water and the residents are in fact gaining by the public project. Instructions are taken on record.
3. Learned counsel for the petitioner, however, submits that the water is getting accumulated, which is not only adversely affecting the nearby farmers but it is also a health hazard. Arrangement ought to be made in the public project for dealing with problems of back flow of water, when check dam is being constructed.

Considering the nature of issue raised before us, we are of the view that appropriate steps ought to be taken to examine the petitioner's grievance and in the event it is found that the construction of check dam is causing inconvenience to the public at large, then remedial measures ought to be taken.

In such view of the matter, we direct the Collector, Mathura to get the facts investigated in light of the complaint raised by the petitioner, within a period of two months from the date of presentation of a certified copy of this order. In the event it is found that petitioner's grievance is genuine, appropriate steps would be taken to introduce remedial measures, as are found expedient in public interest. Such action would be taken within a further period of three months, thereafter.
6. With the above observations/directions, this writ petition stands disposed of.
