1. The Government was directed to respond to various aspects enumerated in the order dated 14th January, 2003. An affidavit dated 25th February, 2003 has been filed by Mr. Vijay Dev, Director in the Ministry of Urban Development & Poverty Alleviation, Department of Urban Development, New Delhi. When the matter was taken up on 3rd March, 2003, some of the parties had stated that they had not been supplied the copy of the affidavit, therefore, it was directed that the same may be circulated to the parties. Their grievance persists. Those parties, who have not been supplied the copies of the affidavit may write a letter to Mr. A.D.N. Rao, who shall forthwith supply the same to them. Further on 3rd March, 2003 on the request of learned Solicitor General, the matter was adjourned so as to enable the Solicitor General to take instructions on the composition of the Task Force. It is unfortunate that neither the Solicitor General is present nor the Attorney General, despite the directions contained in the order dated 14th January, 2003 and the earlier orders, more so, when Mr. Rao appearing for the Government of India is unable to inform the Court about the exact composition of the Task Force except making vague and general submissions that he has learnt about such a Task Force having been constituted.

Further in the order dated 14th January, 2003, the Government of India was directed to place before this Court, the result of Zero based Budgeting exercise and cost benefit to- date conducted on the subsidy scheme specifically for "municipal waste to Energy of the Ministry of Non-Conventional Energy Sources", but the same has not been placed on record. Our attention has been drawn to page 22 of the affidavit dated 25th February, 2003 wherein it has been stated that MNES is in the process of installation of the first demonstration project (5 MW) using municipal solid waste at a total cost of Rs. 65 crore (including MNES subsidy of Rs. 15 crores). This project is expected to be completed by March, 2003. Mr. Rao is unable to state whether the exercise has been completed or not. The importance of the points involved in the petition has been highlighted in various orders including the order dated 14th January, 2003. We reiterate the same and hope that the Government would give serious consideration to the issues which are subject matter of the case. Let the aforesaid aspects be complied with with in 10 days.
3. Out of Rs. 20,000/- lying in deposit the petitioner may be reimbursed her cost.
