INDIAN STATISTICAL SERVICE RULES, 2013

PREAMBLE

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Indian Statistical Service Rules, 1961, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules, namely:-


Rule 1 - Short Title and Commencement

(1) These rules may be called the Indian Statistical Service Rules, 2013. 

(2) They shall come into force on the date of their publication in the Official Gazette.


Rule 2 - Definition

In these rules, unless the context otherwise requires,-

(a) "Board" means the Indian Statistical Service Board referred to in sub-rule (2) of rule 5;

(b) "Commission" means the Union Public Service Commission;

(c) "Controlling Authority" means the Controlling Authority referred to in rule 5;

(d) "DPC" means Departmental Promotion Committee constituted to consider the promotion to or confirmation in any grade as specified in Schedule-III annexed to these rules;

(e) "Duty Post" means any post, whether temporary or permanent, included in rule 4.

(f) "Government" means the Central Government;

(g) "Grade" means any of the grades specified in sub-rule (1) of rule 4;

(h) "MOSPI" means the Ministry of Statistics and Programme Implementation;

(i) "Regular service in relation to any grade" means the period of service in that grade rendered after selection to the grade and included any period,-

(i) taken into account for the purpose of seniority in the case of those already in service at the time of notification of these rules.

(ii) during which an officer would have held a post in that grade but for being on leave or otherwise not being available for holding such posts.

(j) "Schedule" means a Schedule appended to these rules;

(k) "Scheduled Castes" means such castes, races or tribes or parts of or groups within such castes, races or tribes as are deemed under article 341 of the Constitution to be the Scheduled Castes for the purposes of the Constitution;

(l) "Scheduled Tribes" means such Tribes or Tribal Communities or parts of or groups within such Tribes or Tribal Communities as are deemed under article 342 of the Constitution to be the Scheduled Tribes for the purposes of the Constitution; and

(m) "Service" means the Indian Statistical Service (Group 'A') constituted under rule 3.


Rule 3 - Constitution of the Service

There shall be constituted a Service known as the Indian Statistical Service consisting of persons appointed to the service.


Rule 4 - Grade, authorised strength and its review

(1) The duty posts included in various grades of the Service, their number and scales of pay, on the date of commencement of these rules, shall be the following, namely: -

Note: ** out of the 229 posts in the JAG, 127 posts have been upgraded to SAG vide MOSPI's order No. 11015/2/2008-ISS dated 1.9.2008. These posts would revert back to JAG/NFSG level after officers holding the upgraded posts in SAG are adjusted against authorised strength of SAG. The statement of the duty posts of Indian Statistical Service on the date of commencement of these rules in various Ministries or Departments be as specified in the Schedule IV annexed to these rules.

(2) Notwithstanding anything contained in sub-rule (1) of rule 4, the Government may,-

(a) from time to time, by order make temporary additions or alterations to the strength of the duty posts in various grades, for such period as may be specified therein;

(b) in consultation with the Commission, include in the Service such posts which are equivalent in terms of pay band or grade pay or pay scale to the posts included in sub-rule (1) of rule 4;

(c) in consultation with the Commission, appoint an officer to a duty post included in the service under clause (b) to the appropriate grade in a temporary capacity or in a substantive capacity as it considers necessary.

(3) The Non-Functional Selection Grade mentioned in sub-rule (1) of rule 4 in the scale of pay of Rs. 37,400-67,000/- (Grade Pay Rs. 8,700/-) shall have a strength equivalent to 30 percent of the senior duty posts, namely all duty posts at the level of Senior Time Scale and above in the Service:

Provided further that the number of posts in the Non-Functional Selection Grade shall be limited to the number of posts sanctioned in the Junior Administrative Grade.


Rule 5 - Controlling Authority

(1) The Government of India, Ministry of Statistics and Programme Implementation shall be the Controlling Authority of the service.

(2) Major policy matters (cadre review, restructuring of cadre, reviewing the roles and functions of the cadre vis-a-vis other Ministries or Departments or State Governments or Union Territories or foreign Governments and United Nation Organisations or any other matter as decided by the Government from time to time) relating to the management of Indian Statistical Service shall be decided by the Cadre Controlling Authority in consultation with the Indian Statistical Service Board. 

(3) The Board shall be presided over by the Cabinet Secretary and in addition consists of six members of whom at least four shall be the Secretaries of the participating Ministries. The other two members shall be the Secretary, Ministry of Statistics and Programme Implementation and the Director General, Central Statistical Office. (4) The Board may be assisted in matters which are technical in nature, if so required, by a Committee of members consisting of officials and non-officials, without prejudice to the recognised functions and responsibilities of the Commission.

(4) The administrative management of Indian Statistical Service shall be with the Secretary, MOSPI.


Rule 6 - Encadrement of posts to the service

(1) The encadrement of posts to the service and appointment of officers holding duty posts which are encadred into the service under clause (b) and clause (c) of sub-rule (2) of rule 4 shall be as provided in these rules.

(2) The suitability of the officers for appointment in the Indian Statistical Service under clause (c) of sub-rule (2) of rule 4 is subject to their fulfilling the educational qualification as specified in paragraph 6 of Part-II to the Schedule-I. The other eligibility conditions for appointment to various grades of the service shall be determined by the Controlling Authority in consultation with the Commission.

(3) The Government, shall constitute a Selection Committee consisting of a Chairman who shall be the Chairman or a Member of the Commission, and such other members who are the members mentioned in column (2) of Schedule III for respective grades and the suitability of the officers specified in sub-rule (1) of rule 6 for appointment to the different grades of the service shall be determined by such committee.

(4) An officer referred to in sub-rule (1) above who is not found suitable for appointment to any grade in the Service, shall continue to hold his parent post and may be reconsidered by the Controlling Authority for appointment to the Service at a subsequent year in consultation with the Commission. The suitability of these candidates for inclusion in the Indian Statistical Service are subject to fulfilling all the educational qualification as specified in paragraph 6 of Part II to the Schedule-I. The other eligibility conditions for appointment to various grades of the Service shall be determined by the Controlling Authority in consultation with the Commission.

(5) An officer referred to in sub-rule (1), who on selection to any grade in the Service, opts not to be absorbed in the Service, may continue to hold the post held by him immediately before the selection as if he had not been selected.

Explanation: For the purpose of this rule, the absence of a member other than the Chairman or a Member of the Commission shall not invalidate the proceeding of the Selection Committee.


Rule 7 - Future Maintenance of the Service

The duty posts in any of the grades referred to in rule 4, shall be filled in the following manner namely:

(1) 50 percent of the total duty posts in the Junior Time Scale shall be filled by direct recruitment through an open competitive examination to be held by the Commission as specified in Schedule-I;

(2) 50 percent of the total duty posts in the Junior Time Scale shall be filed by promotion from amongst officers belonging to the Subordinate Statistical Service with Grade Pay Rs. 4600 in the pay scale of Rs. 9300-34,800/- in Pay Band-2 with three years regular service in the grade.

(3) All substantive appointments of officers recruited to the Service through competitive examination shall be made in the entry grade only, namely, Junior Time Scale of the Service. The date of appointment of direct recruit shall be the date on which he or she was recommended by the Commission for appointment to the Junior Time Scale. The date of appointment of promotee officer shall be the date on which he or she was included in Select List recommended by Commission for Promotion to Junior Time Scale or the date on which officer was appointed to the Junior Time Scale whichever is later. The date of appointment of officers encadred to the service shall be the date on which he or she was included in Select List recommended by Commission for inclusion in the Indian Statistical Service or the date on which officer was appointed in the Indian Statistical Service, whichever is later.

(4) The date of appointment of officers promoted to the Senior Time Scale and above shall be the date on which he or she was included in the Select List as recommended by the Departmental Promotion Committee as specified in Schedule III for promotion to that grade, or the date on which he or she was appointed to the grade, whichever is later.

(5) The field of selection and eligibility criteria for promotions to various grades of the Service shall be as specified in Schedule II.

(6) The promotion of officers to various grades shall be made by the method of 'selection', except placement of officers in the Non-Functional Selection Grade of the Junior Administrative Grade, which shall be on Non-Selection basis, on the basis of the recommendations of the Departmental Promotion Committee constituted in accordance with Schedule III.

(7) Whenever any Indian Administrative Service officer of the State or Joint Cadre is posted at the Centre to a particular Grade carrying a specific Grade Pay in Pay Band 3 or Pay Band 4, or on the Higher Administrative Grade Scale, the members of the Service, who are senior to such Indian Administrative Service officer by two years or more and have not so far been promoted to that particular grade, shall be appointed to the same grade on Non-Functional basis from the date of posting of the Indian Administrative Service officer in that particular grade. This will be subject to satisfaction of eligibility criteria for promotion to the relevant Grade and other instructions issued by the Central Government from time to time and based on the recommendations of the Screening Committee constituted in accordance with Schedule V.


Rule 8 - Probation

(1) Every officer appointed to the Service, either by direct recruitment or by promotion in Junior Scale shall be on probation for a period of two years:

Provided that the Controlling Authority may extend the period of probation in accordance with the instructions issued by the Government from time to time:

Provided further that any decision for extension of a probation period shall be taken ordinarily within eight weeks after the expiry of the previous probationary period and communicated in writing to the concerned officer together with reasons for so doing, within the said period.

(2) On completion of the period of probation or any extension thereof, officers shall, if considered fit for permanent appointment, be retained in their appointments on regular basis and be confirmed in due course against the available substantive vacancies, as the case may be.

(3) If, during the period of probation or any extension thereof, as the case may be Government is of the opinion that an officer is not fit for permanent appointment, Government may discharge or revert the officer to the post held by him prior to his appointment in the service, as the case may be.

(4) During the period of probation, or any extension thereof, candidates may be required by the Government to undergo such courses of training and instructions and to pass such examinations and tests (including examination in Hindi) as it may think fit, as a condition to satisfactory completion of probation.

(5) As regards other matters relating to probation, the members of the Service shall be governed by the instructions issued by the Government in this regard from time to time.


Rule 9 - Seniority

(1) The seniority of the officers of the Service, appointed to any grade shall be governed by their relative seniority obtained immediately before the date of commencement of these rules:

Provided that if the seniority of any officer of the service has not been determined before the commencement of these rules, the same shall be determined in accordance with the Indian Statistical Service Rules, 1961 applicable to officers of the Service before the commencement of these rules.

(2) The seniority of persons appointed to the grade of Junior Time Scale shall be determined as follows:

(i) The inter-se seniority amongst the officers promoted from the Subordinate Statistical Service shall be determined in the order of their selection for such promotion and the officer promoted on the basis of an earlier selection shall rank senior to those promoted on the basis of subsequent selection;

(ii) The inter-se seniority amongst the direct recruits shall be in the order of their selection by the commission and any person appointed on the basis of an earlier selection to the service shall rank senior to all other persons appointed on the basis of any subsequent selection to the service.

(3) The inter-se seniority of officers appointed to the service under rule 6 (i.e. encadred to the service) after the commencement of these rules to the entry grade (i.e. grade at which officer is encadred to) shall be determined in the order of their position in the respective select lists for inclusion in the Indian Statistical service to such grade and any person appointed on the basis of an earlier selection to the service shall rank senior to all other persons appointed on the basis of any subsequent selection to that grade of the service.

(4) The inter-se seniority of officers appointed to the Senior Time Scale and above of the service shall be determined in the order of their position in the respective select lists for inclusion into such grades of the service and those included on the basis of an earlier selection shall rank senior to those promoted on the basis of a subsequent selection in the service.


Rule 10 - Other Conditions of service

(1) Officers appointed to the service shall be liable to serve anywhere in India, including field service in or out of India. The controlling authority may provide for-

(i) suitable transfer and relieving policy for its officers for the smooth functioning of the service; and 

(ii) suitable professional training course for officers of any grade to qualify for confirmation in the grade or for promotion to a higher grade.

(2) The conditions of the service of the officer of the Service in respect of matters for which no provision has been made under these rules shall be the same as are applicable from time to time, to the officers of equivalent rank of the Central Government.


Rule 11 - Deputation

(1) Notwithstanding anything contained in rule 8, where the Government is of the opinion that it is necessary or expedient so to do, it may for reasons to be recorded in writing and in consultation with Commission, fill-up duty posts in any grade by deputation for period not exceeding three years, which may in special circumstances be extended upto five years, as the Government may think fit. The qualification, experience and the qualifying service for appointment to any grade of the Service under this rule shall be decided by the Government in consultation with the commission on each occasion.

(2) The Controlling Authority may depute, from time to time, members of the Service to work in posts under any State Government or Non-Governmental Organization or international organization including foreign governments for a specified period to enable them to enrich their experience and make them more suitable for holding duty posts in the Service.


Rule 12 - Disqualification

No person- 

(a) who has entered into or contracted a marriage with a person having a spouse living, or 

(b) who, having a spouse living, has entered into or contracted a marriage with any person, 

shall be eligible for appointment to the Service:

Provided that the Government may, if it is satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule.


Rule 13 - Residuary matters

The conditions of service of the members of the Service in respect of matters for which no provision is made in these rules shall be the same as are applicable from time to time to officers of equivalent rank of the Central Government.


Rule 14 - Power to relax

The Government may, in consultation with the Commission, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.


Rule 15 - Interpretation

If any question relating to the interpretation of these rules arises, it shall be decided by the Government


Rule 16 - Saving

Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-service men and other special categories of persons in accordance with the orders issued by the Government from time to time in this regard.


Schedule I - SCHEDULE I

SCHEDULE I

PART 1

(See rule 8(1))

DIRECT RECRUITMENT THROUGH THE UNION PUBLIC SERVICE COMMISSION

1. Direct recruitment to Junior Time Scale of the service shall be made through an open competitive examination in the manner prescribed in Part II of this Schedule.

2. A candidate for the examination must be a citizen of India or he must belong to such categories of persons as may from time to time be notified by the Government.

3. Any attempt on the part of a candidate to obtain support for his candidature by any unfair means may be held by the Commission to disqualify him for admission to the examination.

4. Success in the examination confers no right for appointment, unless Government is satisfied, after such inquiry, as may be considered necessary, that the candidate is suitable in all respects for appointment to the service.

5. No candidate shall be appointed to the service, who after such medical examination, as the Government may prescribe, is not found to be in good mental or bodily health and free from any mental or physical defect likely to interfere with the discharge of the duties of the service.

6. No person- 

(a) who has entered into or contracted a marriage with a person having a spouse living, or 

(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the Service:

Provided that the Government may, if it is satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule.

PART-II

RECRUITMENT THROUGH COMPETITIVE EXAMINATION TO JUNIOR TIME SCALE OF THE SERVICE:

1. Holding of examination.- An examination (hereinafter referred to in this schedule as "examination") for appointment to Junior Time Scale of the Service shall be held at such time and places as may be prescribed in the notice issued by the Commission for the purpose. Every such Notice will, when possible, announce the number of vacancies to be filled on the result of the examination.

2. Conduct of Examination.- Every examination shall be conducted by the Commission in such manner as maybe notified by the Government from time to time.

3. Combined Examination.- If an examination held under this part is a combined examination for the purpose of making appointments to more than one service, the following provisions shall apply, namely:-

a. any person may apply to be admitted as a candidate for appointment in all or any of the services for which he is eligible. If he wishes to be considered for appointment in more than one service, he shall state in his application for the names of the services for which he wishes to be considered, and the order of his preferences for them and in such cases only one application form will be necessary and one payment of the fee referred to in paragraph 7 will be sufficient.

b. Government shall assign successful candidates to each service on a consideration of all circumstances, including any personal preference expressed by the candidates.

4. Form of Making Application.- A candidate must apply for admission to the examination, before such date, in such manner and in such form, as the Commission may prescribe.

5. Age limit.- A candidate must have attained the age of 21 years and must not have attained the age of 30 years on the first day of August of the year during which the examination is held:

Provided that the upper age limit may be relaxed in respect of such categories as may be notified by the Government from time to time to the extent and subject to the conditions notified in respect of each category.

6. Educational Qualifications.- A candidate must have obtained

i) a Bachelor's degree with Statistics/Mathematical Statistics/Applied Statistics as one of the subject or a Master's degree in Statistics/Mathematical Statistics/Applied Statistics from a University incorporated by an Act of the Central or State Legislatures in India or other Educational Institutes established by an Act of the Parliament or declared to be deemed as Universities under Section 3 of the University Grants Commission Act, 1956 or a foreign University approved by the Central Government from time to time.

Note: In exceptional cases, the Commission may treat a candidate not possessing the qualification prescribed above, as educationally eligible provided that he/she has passed examinations conducted by other Institutions, the standard of which in the opinion of the Commission justified his admission to the examination.

ii) Candidates who are otherwise eligible but who have taken degrees from foreign universities which are not recognized by the Government may also apply for admission to the examination and may be admitted at the discretion of the Commission.

iii) A candidate who has appeared or intends to appear at such a qualifying examination, the passing of which would render him eligible to appear at the examination may apply for admission to the examination. Such a candidate will be admitted to the examination, if otherwise eligible, but the admission would be deemed to be provisional and subject to cancellation if he does not produce the proof of having passed the examination as soon as possible and in any case not later than two months after the commencement of the examination.

7. FEE.- A candidate must pay the fee prescribed by the Commission, unless exempted there from or granted concession thereof in accordance with the exemption and/or concessions in this respect notified from time to time.

8. The decision of the Commission as to the eligibility or otherwise of a candidate for admission to the examination shall be final and no candidate to whom a certificate of admission has not been issued by the Commission shall be admitted to the examination.

9. Penalty for Misconduct.- A candidate who is or has been declared by the Commission guilty of impersonation or of submitting fabricated document or documents which have been tampered with, or of making statements which are incorrect or false, or of suppressing material information or otherwise resorting to any other irregular or improper means for obtaining admission to the examination, or of using or attempting to use unfair means in the examination hall, may, in addition to rendering himself liable to criminal prosecution,

a) be debarred permanently or for a specified period by the Commission from admission to any examination or appearance at an interview held by the Commission for selection of candidates;

b) be debarred by the Government from employment under them; and

c) be liable to disciplinary action under the appropriate rules, if he/she is already in service under the Government.

10. Preparation of list of successful candidates.- After the examination, the candidates will be arranged by the commission in the order of merit as disclosed by the aggregate marks finally awarded to each candidate; and in that order so many candidates as are found by the Commission in their discretion to be qualified in the examination shall be recommended for appointment upto the number of unreserved vacancies decided to be filled on the results of the examination.

Provided that any candidate belonging to Scheduled Caste, Scheduled Tribe or OBC, who though not qualified by the standard prescribed by the Commission is declared by them to be suitable for appointment thereto with due regard to the maintenance of efficiency of administration, shall be recommended for appointment to vacancies reserved for the respective groups.

11. The examination shall comprise written examination, followed by viva voce of such candidates, as may be called by the Commission, subject to the condition that the marks allocated for viva voce shall not exceed 20% of the total marks allocated for the written examination.

12. The details of standard and syllabi for the examination, and other aspects of conducting the examination shall be as prescribed by the Commission from time to time.

Officers in the Junior Administrative Grade on entering the fourteenth year of overall regular service on 1st January of the year calculated from the year following the year of examination on the basis of which the officer was recruited.

Note: The Junior Administrative Grade officers who entered the Indian Statistical Service by the method of promotion in the Junior Time Scale of the Service shall also be considered eligible for appointment in the Junior Administrative Grade (Non Functional Selection Grade), provided they have entered the fourteenth year of service in Group 'A' by following the Rules governing seniority along with officers who entered the fourteenth year of service through the method of direct recruitment.

Note I: For the purpose of promotions to Senior Time Scale (STS), Junior Administrative Grade (JAG), Senior Administrative Grade (SAG) and Higher Administrative Grade (HAG), the length of service shall be reckoned from the 1st of January of the year following the year of the examination through which the member was recruited.

Note II: In cases where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years whichever is less and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.
