BIHAR POLICE TELECOMMUNICATIONS (WIRELESS) AND TECHNICAL NON-GAZETTED CADRE RULES, 2021

PREAMBLE

In exercise of the powers conferred by proviso of Article 309 of the constitution of India read with Section 55 and Section-94 of Bihar Police Act, 2007, the Governor of Bihar is pleased to make the following rules to amend the Telecommunications, Subordinate Officer (Operation) Recruitment, Promotion and Cadre Rules, 1989 (as amended from time to time), as follows:-

Rule - 1. Short title, Extent and commencement.

(1)     These Rules will be called the "Bihar Police Telecommunications (Wireless) and Technical Non-Gazetted Cadre Rules, 2021".

(2)     It shall extend to the whole of the State of Bihar.

(3)     It shall come into force with immediate effect.

Rule - 2. Definitions.

In these rules unless the context otherwise requires-

(i)       "Government" means Bihar Government;

(ii)      "Department" means Home Department (Police Branch), Government of Bihar;

(iii)     "Selection Board" means Central Selection Board (Constable Recruitment);

(iv)    "Subordinate Service Commission" means Bihar Police Subordinate Service Commission;

(v)      "Commission" means Bihar Public Service Commission;

(vi)    "Cadre Controlling Authority" means Director General of Police, Bihar, Patna for constable to Police Inspector;

(vii)   "Appointing Authority" means

(A)     SP (Wireless) for Constable (Operation) and Constable (Technical);

(B)     SP (Wireless) for Havildar (Operation) and Havildar (Technical);

(C)     DIG (Wireless and Technical Services) for Assistant Sub-Inspector (Operation) and Assistant Sub-Inspector (Technical);

(D)     DIG (Wireless and Technical Services) for Sub-Inspector (Operation) and Sub-Inspector (Technical);

(E)     Director General of Police, Bihar for Police Inspector (Operation) and Police Inspector (Technical);

(viii)  "Cadre" means Bihar Police Telecommunications (Wireless) and Technical Non-Gazetted Cadre;

(ix)    "DCPW" means Directorate of Co-ordination of Police Wireless, Ministry of Home, New Delhi;

(x)      "Director General of Police" means officer appointed under Section 5(1) of Bihar Police Act, 2007;

(xi)    "Bihar Police Radio Organization" means the organization which is a part of Bihar Police and which arranges the State-wide transmission of messages pertaining to Law & Order and Crime prevention and Investigation. Apart from this, if needed, arranges the transmission of messages as directed by the State Government or Director General of Police in matters relating to natural disasters;

(xii)   "Bihar Police Radio Headquarters" means Bihar Police Radio Organization office situated at Patna;

(xiii)  "Schedule" means the schedule attached with this rule.

Rule - 3. Organisation of Cadre.

(A)     This cadre will be a closed cadre. The hierarchy of post of this cadre will be as follows:-

(B)     The Pay scale/Pay level of above posts will be same as fixed by State Government from time to time.

Rule - 4. Cadre Strength.

(i)       Strength of the cadre will be according to the present strength, however, cadre will be considered accordingly revised based on creation of posts or termination of posts by State Government from time to time, as needed.

(ii)      All the staff of this cadre (except for ministerial staff) will wear dresses as fixed for equivalent posts of General Police force, however they will not be adjusted in the General Police cadre.

(iii)     All the officers and staff of Bihar Police Radio Organisation who were working before the date of commencement of this rule will be considered the members of this cadre.

Rule - 5. Appointment, Promotion, Training and Confirmation in the Cadre.

(I)      Appointment, Training and Confirmation on the post of Constable (Operation) and Constable (Technical)

(A)     All posts of Constable (Operation) and Constable (Technical) shall be filled by the citizens of India through direct recruitment on recommendation of the selection board.

Proviso: Upon shortage of manpower on the post of Constable (Operation) and on the possibility of delay in appointment to this post, a maximum of 25 percent of the posts can be filled on deputation basis temporarily by constables of other units of police force, who may be having minimum desired qualification fixed for appointment as Constable (Operation), after approval of Director General of Police and they will not be permanently absorbed in Bihar Police Radio organization and after direct appointment of constable (Operator) they will be reverted back to their parent organization/units.

(B)     Minimum Educational Qualification.

For the post of Constable (Operation), the minimum educational qualification will be passing Intermediate (Science) or equivalent with minimum fifty percent (50%) marks in Physics, Chemistry and Mathematics subjects. The corresponding minimum passing marks for candidates of Scheduled Castes/Scheduled Tribes will be forty five percent (45%). Minimum educational qualification for the post of constable (Technical), (a) Electronics & Communications, (b) Electronics & Tele-Communications, (c) Information Technology, or (d) Electrical & Electronics, passed in a two-year NCVT/SCVT course in any discipline from the Bihar government recognized ITI institute with minimum Fifty percent (50%) marks. For the candidates belonging to Scheduled Castes/Scheduled Tribes minimum Forty five percent (45%). Have also passed Hindi and English as per the prescribed course for class 12th from Bihar school examination board under the prescribed provision in kandika-2 of office order no-342 dt.-09-07-2018 of the dept. of education govt. of Bihar is equivalent to passing (Hindi and English examination in the same year and passed ITI with or after that year) is equivalent to 12th standard.

(C)     Age Limit.

Age Limit of the candidates will be as follows:-

(i)       Minimum 18 years and Maximum 25 years for general category;

(ii)      Minimum 18 years and Maximum 27 years for male candidates of Backward class category and Extremely Backward Class category;

(iii)     Minimum 18 years and Maximum 28 years for female of Backward class category and Extremely Backward Class category and;

(iv)    Minimum 18 years and Maximum 30 years for male and female candidates of Scheduled Castes and Scheduled Tribes

(D)     Selection Process and Methodology.

(i)       For the post of Constable (Operation) and Constable (Technical), qualified candidates shall be recommended by the Selection Board based on separate/combined competitive examination. Combined competitive examination could be held along with examination for appointment to the post of general constables. Upon request from Bihar Police Radio Headquarters, a requisition shall be sent to Selection Board in prescribed Proforma by the Director General of Police, mentioning reservation category-wise number of vacant posts. The selection Board shall appoint examiners for selection of question papers, conduction of written examination and checking of answer booklets and will organise physical ability test and send the recommendation list of successful candidates to the appointing authority.

(ii)      Based on the requisition received from the Director General of Police, the Selection Board shall advertise the vacancies via website and widely circulated News Papers. Candidates shall have to follow the directions and terms/conditions given in the advertisement. The candidates shall be charged the examination fee as fixed by the Selection Board. The candidates shall submit their applications in prescribed format, online through the website of Selection Board subject to terms and restrictions contained in the advertisement published by the Selection Board. In the prescribed format. In case of combined competitive examination, the candidates having desired qualifications will have to indicate their preference for selection of posts.

(iii)     The Selection Board shall organise a written examination for all the candidates in the first phase. The question paper of written examination will be based on multiple choice questions. The written examination question paper shall be of One Hundred (100) marks and have a total of One hundred (100) questions, and the duration of the examination shall be of two hours. One (01) mark shall be awarded for each correct answer. The candidates scoring less than thirty (30) % marks in this examination shall be declared unsuccessful for the physical ability test. The aforesaid question paper for the post of Constable (Operation) shall have Twenty Five (25) questions of General knowledge and current affairs and Twenty Five (25) questions of intermediate level each from Physics, Chemistry and Mathematics subjects.

The aforesaid question paper for the post of Constable (Technical) shall have Twenty Five (25) questions of General knowledge and current affairs and Seventy Five (75) questions related to subjects of group (A) Electronics & Communication or group (B) Electronics & Tele-Communications, or group (C) Information Technology, or group (D) Electrical & Electronics. The candidates shall choose any one of the groups from (A) to (D) and answer questions therein. The answer booklet shall be in two copies, out of which one copy shall be kept safe by the Selection Board for a period of one year since the date of declaration of examination result; however in case any case is under consideration in court then the answer booklets of the aforesaid examination shall be kept safe until disposal of the case.

(iv)    Based on the scores of written examination, a maximum number of Five (5) times of vacancies candidates shall be selected for physical ability test, based on the reservation category-wise. The Selection Board would be empowered to reduce the above ratio, in case if sufficient number of qualified candidates are not available for physical ability test.

(v)      The Selection Board shall hold physical ability test for candidates selected on the basis of written examination in phase-1 and The physical ability test shall be of qualifying nature only. The physical parameters and ability tests shall be as prescribed in the Schedule "A" which is a part of these rules. Modern technology based transparent processes and computer based methodologies shall be used to examine the physical measurement test and other tests. As per need, and as far as possible, videography of the procedure will also be carried out. The Selection Board shall intimate the information about provisionally successful and un-successful candidates in physical ability test to all candidates on a daily basis. The candidates dissatisfied with height and chest measurement would be allowed to register their objections before the Selection Board, the same day. The Selection board shall dispose-off objection petitions on the same date when they are received.

(E)     Preparation of Merit List.

(i)       From the successful candidate in physical ability test the merit list of finally successful candidates for selection shall be prepared based reservation category wise on the written examination scores.

(ii)      In case of a combined examination, the merit list of finally successful candidates will be prepared separately based on the post preferences indicated by the candidates.

(iii)     In the case of two or more candidates scoring equal marks in the written examination, their positions in the merit list shall be determined based on their date of birth; i.e. candidates senior by age shall be placed higher in the merit list. In case of candidates scoring equal marks and having same date of birth, their positions in the merit list shall be determined on the basis of their educational qualifications, which means that the candidates having comparatively higher educational qualification shall be placed higher in the merit list. Despite of this, if more than one candidates have same written examination score and same date of birth then their seniority shall be determined on the basis of their marks scores in the qualifying educational examination. If the merit position still can not be determined, then their positions shall be ascertained on the basis of their names as given in the 10th board certificate, using English language alphabetical order.

(iv)    The Selection Board shall prepare the merit list of candidates, having minimum qualifying marks in descending order of scores obtained, and shall recommend the reservation category-wise names in descending order of merit according to the requisition of the Director General of Police.

(v)      Upon the request of the Director General of Police, the Selection Board shall issue supplementary recommendation lists for appointment to the posts vacant due to non-reporting of candidates, up to a period of six (06) months. The duration of six (06) months shall be calculated from the date of publication of merit list.

(F)      Medical Examination, Verification of Character and past antecedents.

(i)       Before the appointment to the post of Constable (Operation) and Constable (Technical), the appointing authority shall get the medical examination as per form No. 103 and Verification of Character and past antecedents as per form No. 101 of Bihar Police Manual, 1978. In case of receipt of adverse reports, and/or concealment of facts by the candidates, the concerned candidates shall be declared unfit for the appointment.

(ii)      As per the provision of Rule 658(iv) of Bihar Police Manual, the candidate should be free from such ailments, structural deformities and physical weakness which would or could make him/her unfit for duties.

Note 1- Medical examination of all selected candidates shall be carried out before appointment. Defects in eye-sight, color blindness, hearing impairment, stuttering, flat-foot, knocking-knee etc shall be checked during medical examination. For appointment, it shall be compulsory for selected candidates to be found fit in the medical examination.

Note 2- Candidates having stuttering or stammering problems shall be deemed unfit for selection.

(G)     Training.

(i)       Constable (Operation) and Constable (Technical) will be imparted basic training of Grade -III for ten months duration.

(ii)      Initial training, which will be of three months, covering Law, Drill and Police Manual at Constable Training College or Constable Training School, whatever is applicable. Thereafter, they will complete a seven month gradation and technical course (technical and operation related) training fixed as per standard of DCPW or Director General of Police from signal school or from any appropriate signal training school.

(iii)     There shall be a training routine during training. A monthly routine test shall be held for the assessment of progress of the trainees.

There shall be a final written examination for internal subjects only in the end of the training. Passing marks in all subjects shall be as prescribed by DCPW. Candidates who fail in the first attempt, shall be subjected to one month intense indoor training course and at the completion of which, second examination will also be conducted. Those who fail in the second attempt, shall be placed under intense training for one month and examined at the end of this coaching. Those who fail in the third attempt, shall be relieved from the service.

(H)     Seniority.

The seniority of constables (Operation)/Constable (Technical) who pass the final written examination of basic training of Grade-III in first attempt, will be determined according to scores of internal subject examination and score of written examination conducted by the Selection Board. Both shall have proportionate weightage. Those who fail in the first examination and pass in second attempt, shall be placed below those who have passed in first attempt, and their seniority will be according to their merit obtained in the second examination of internal subjects. Those who have passed in the third attempt, shall be placed below those who passed in first and second attempt, and their position in the list shall be based on marks obtained in the internal subjects according to merit list.

(I)      Departmental Examination.

Constable (Operation) and Constable (Technical) have to pass the Grade-III course examination.

(J)      Confirmation.

All those constables (Operation)/constables (Technical) who have passed the Grade-III training and completed one year of service in the field shall be confirmed.

(II)     Promotion, Training and Confirmation from the post of Constable (Operation) and Constable (Technical) to the post of Havildar (Operation) and Havildar (Technical) respectively.

(A)     All posts of Havildar (Operation) and Havildar (Technical) shall be filled by promotion from Constable (Operation) and Constable (Technical) respectively. Only confirmed constables shall be considered eligible for promotion. All confirmed constables (Operation) and constables (Technical) shall have to complete forty five (45) days training in their respective cadres, based on syllabus fixed after approval from the Director General of Police, and shall have to pass in the test examinations. After this, they will be eligible for promotion. Promotion shall be in accordance with the rules and terms as fixed by the State Government and Police Headquarters. For promotion, the time bound issued by the General Administration Department of State Government shall be applicable.

(B)     Promotion shall be given based on seniority-cum-merit yardstick, which shall be considered on the recommendation of Board of Director General of Police. This board shall be constituted under the Chairmanship of DIG (Wireless & Technical Services), or equivalent officer with two SP Rank officers as members and one of them shall belong from the Scheduled Castes/Scheduled Tribes.

(III)   Appointment, Promotion, Training and Confirmation to the post of Assistant Sub-Inspector (Operation) and Assistant Sub-Inspector (Technical) -

1.        Fifty percent (50%) posts of Assistant Sub-Inspector rank shall be filled by promotion of confirmed Havildars and rest fifty percent (50%) posts shall be filled by direct appointment done by the appointing authority on recommendation of Subordinate Service Commission.

2.        Direct Appointment -

(A)     Minimum Educational Qualification.

For the post of Assistant Sub-Inspector (Operation), minimum educational qualification shall be Graduate (B.Sc.) from a recognized university with physics subject and passing with minimum fifty percent (50%) marks, and for Assistant Sub-Inspector (Technical), minimum educational qualification shall be three year diploma course from any State Government or Central Government recognized polytechnic institute in either Electronics & Communication, or Electronics & Tele-communications, or Information Technology, or Electrical & Electronics subjects and passing with minimum fifty percent (50%) marks. For scheduled caste and scheduled tribe candidate the passing marks will be 45% for both post.

(B)     Age Limit.

Age limit for the candidates shall be as follows:-

(i)       Minimum 20 years and maximum 30 years for male candidate of general category;

(ii)      Minimum 20 years and maximum 33 years for male candidate of Backward Classes and Extremely Backward Classes;

(iii)     Minimum 20 years and maximum 33 years for female candidates of Backward Classes and Extremely Backward Classes; and

(iv)    Minimum 20 years and maximum 35 years for male and female candidate of scheduled castes and scheduled tribes.

(C)     Selection Process and Methodology.

(i)       Upon request from Bihar Police Radio Headquarters, a requisition shall be sent in prescribed format (Proforma) of Subordinate Service Commission, by the Director General of Police, mentioning reservation category-wise number of vacant posts. The Subordinate Service Commission shall ensure for setting question papers, conduction of written examination and appoint examiners for checking of answer booklets, and shall organise physical ability test and send recommendation list of successful candidates to the appointing authority.

(ii)      According to the requisition obtained from the Director General of Police, the Subordinate Service Commission shall get advertised the vacancies through widely circulated news papers and website. Candidates shall have to follow the terms and directions given in the advertisement. Candidates shall be charged examination fee, as fixed by the Subordinate Service Commission. Candidates shall submit their application online in prescribed format, at the website of Subordinate Service Commission, subject to terms and restrictions contained in the advertisement.

(iii)     The Subordinate Service Commission shall organise a written competitive examination for all candidates. Written examination shall be held in two phases viz.-

preliminary and main examination. All question papers of the written examination shall be based on objective multiple choice questions. In first phase, preliminary examination shall be held which will have a question paper of one hundred (100) marks wherein one hundred (100) objective multiple choice questions will be there and the duration of examination shall be two hours. In the aforesaid question paper, for Assistant Sub-Inspector (Operation), there will be forty (40) questions related to general knowledge and current affairs and sixty (60) questions related to physics subject; level of questions will be of Graduate Science level. For Assistant Sub-Inspector (Technical), forty (40) questions related to general knowledge and current affairs and sixty (60) questions related to subjects related to group (A) Electronics & Communication, or group (B) Electronics & Telecommunications, or group (C) Information Technology, or group (D) Electrical & Electronics. Candidates will have to choose one of the groups from (A), (B), (C) or (D) and answer sixty (60) questions therein. Questions will of the level of polytechnic. Candidates scoring less than 30% marks in the preliminary examination shall be declared unsuccessful for the main examination. Based on the scores of the preliminary examination, candidates equal to twenty (20) times of vacancies shall be selected reservation category-wise for main examination. Subordinate Service Commission shall be competent to suitably reduce the above ratio if adequate number of qualified candidates are not available for the main examination.

(iv)    Main examination will have two question papers. In first paper will be related to language knowledge and one hundred (100) marks in which fifty (50) questions will be from general Hindi and fifty (50) questions from general English subject. Questions will be of the intermediate level and will be of objective multiple choice type. A minimum qualifying marks will be 30 and it would be compulsory to pass this paper, failing which the candidates shall be declared unfit. The duration for general language knowledge paper will be one and half hours. Marks obtained in the general language knowledge paper will not be added while determining the merit list.

(v)      The second question paper will be of graduate physics subject for Assistant Sub-Inspector (Operation) and for Assistant Sub-Inspector (Technical), the second paper will comprise of group (A) Electronics & Communication, or group (B) Electronics & Tele-communications, or group (C) Information Technology, or group (D) Electrical & Electronics, out of which one group subject will have to be chosen for examination. This question paper will be objective multiple choice question and wherein one hundred (100) objective multiple choice questions will be there and full marks will be 100 and the duration of examination shall be three hours. There will be a negative marking of zero point two (0.2) marks per wrongly answered question in the examinations of both the phases. Answer booklet will be in two copies, one of which shall be kept safe with the Subordinate Service commission. It will be compulsory to obtain a minimum of thirty three percent (33%) marks in the second paper examination. Candidates scoring lesser marks shall be declared unsuccessful.

(vi)    In the second phase examination, candidates maximum 05(five) times of vacancies will be selected reservation category wise for physical ability test, based on the marks obtained in the second question paper. In the event of adequate number of qualified candidates being unavailable for physical ability test, the subordinate service commission would be able to reduce the above ratio suitably. The physical measurement and ability test shall be, as prescribed in the schedule "B" of this rule, which is a part of these rules.

(D)     Preparation of Merit List.

(i)       The merit list of finally successful candidates shall be prepared as per the reservation category-wise vacancies out of the candidates successful in physical ability test, on the basis of marks obtained in the second paper of the main examination.

(ii)      In case of combined competitive examination being held, the merit list of finally successful candidates shall be prepared separately on the basis of preference given by the candidates.

(iii)     In case of two or more candidates scoring equal marks in the written main examination, their positions in the merit list shall be determined based on their date of birth; i.e. candidates senior by age shall be placed higher in the merit list. In case there are two or more than two candidates scoring equal marks and having same date of birth, their positions in the merit list shall be determined on the basis of their educational qualifications which means that the candidates having comparatively higher educational qualification shall be placed higher in the merit list. Despite of this, if more than one candidates have same written examination score and same date of birth then their seniority shall be determined on the basis of their scores in the qualifying educational examination meaning that candidate having higher score shall be placed higher in the merit order. If the merit position still can not be determined, then their positions shall be ascertained on the basis of their names as given in the 10th board certificate, using English language alphabetical order.

(iv)    Subordinate Selection Commission shall prepare list of candidates scoring minimum qualifying marks in descending order of merit, reservation category-wise, based on requisition obtained from the Director General of Police and recommend names in the descending order of merit scores.

(v)      Upon request of the Director General of Police, the Subordinate Service Commission shall issue supplementary recommendation lists for appointment to the posts vacant due to non-reporting of candidates, up to a period of six (06) months. The duration of six (06) months shall be calculated from the date of publication of merit list.

(E)     Medical Examination and verification of character and past antecedents.

(i)       Before the appointment to the post of Astt. Sub-Inspector (Operation) and Astt. Sub-Inspector (Technical) the appointing authority shall ensure the medical examination, as per form No. 103 and verification of character and past antecedents as per form No. 101 of Bihar Police Manual, 1978. In case of receipt of adverse reports, and/or concealment of facts by the candidates, the concerned candidates shall be declared unfit for the appointment.

(ii)      As per the provision of Rule 658(iv) of Bihar Police Manual, the candidate should be free from such ailments, structural deformities and physical weakness which would or could make him/her unfit for duties.

(F)      Training.

(i)       Assistant Sub-Inspector (Operation) and Assistant Sub-Inspector (Technical) will be imparted a nine month basic training in Grade-II course.

(ii)      Directly recruited Assistant Sub-Inspector shall undergo a three month initial training in Law, drill and police manual etc. Thereafter, they will complete a six month technical routine (technical and operation related) training at DCPW, or State Headquarters or any suitable signal school as per the standards prescribed by DCPW or Director General of Police.

(iii)     There shall be a training routine during training. A monthly test shall be held for assessment of progress of the trainees. There shall be a final written examination for internal subjects only at the end of the training. Passing marks in all subjects shall be as prescribed by DCPW. Candidates who fail in the first attempt, shall be subjected to one month intense training course, and second examination will also be conducted at the completion of intense training course. Those who fail in the second attempt, shall be placed under intense training for one month and examined at the end of this coaching. Those who fail in the third attempt, shall be relieved from service.

(G)     Seniority.

The seniority of those Assistant Sub-Inspector (Operation) and Assistant Sub-Inspector (Technical), who pass the final written examination of Grade-II training in first attempt, shall be determined on the basis of order of merit, based on marks obtained in the internal subjects and marks obtained in the second question paper of the main examination conducted by Subordinate Service Commission. Both will have proportionate weightages and those who have passed in second attempt shall be placed below those who have passed in the first attempt, and their seniority will be in accordance with their scores obtained in the internal subjects of second examination. Those who pass in the third attempt, shall be placed below those who passed in first and second attempts, and their position in seniority list will be on the basis of marks scored in the internal subjects.

(H)     Confirmation.

All those Assistant Sub-Inspectors (Operation)/Assistant Sub-Inspectors (Technical) who have passed Grade-II course and completed one year field service, shall be confirmed.

(I)      Departmental Examination.

For Assistant Sub-Inspector (Operation) and Assistant Sub-Inspector (Technical), it shall be compulsory to pass the Hindi Noting and Drafting examination organised by the Department of Cabinet Secretariat (Raj-Bhasha Branch), Government of Bihar. Second and successive pay increments shall be payable only after passing of the aforesaid examination.

3.        By Promotion -

(A)     Fifty percent (50%) posts of Assistant Sub-Inspector (Operation) and Assistant Sub-Inspector (Technical) shall be filled by promotion of confirmed Havildar (Operation) and confirmed Havildar (Technical) respectively. Only confirmed Havildars (Operation) and confirmed Havildars (Technical) will have to undergo six month Grade-II routine training in their respective cadres and pass in the test examinations; the syllabus of training will be as per DCPW or benchmarks fixed by the Director General of Police.

(B)     Promotion shall be given according to seniority-cum-merit basis, which shall be considerable on recommendation of the Board of Director General of Police. The board shall be constituted under the Chairmanship of DIG (Wireless & Technical Services), or equivalent officer with two SP Rank officers as members and one of the two members must belong from the Scheduled Castes/Scheduled Tribes.

4.        Mutual Seniority between directly recruited Assistant Sub-Inspector and Assistant sub-inspector promoted from Havildar -

Assistant Sub-Inspector promoted from Havildar shall be placed above the directly recruited Assistant Sub-Inspector recruited in the year of former's promotion to their cadre.

(IV)   Promotion, Training and Confirmation to the post of Police Sub-Inspector (Operation) and Police Sub-Inspector (Technical) -

(A)     Promotion.

All posts of Police Sub-Inspector (Operation) and Police Sub-Inspector (Technical) shall be filled by promotion of confirmed Assistant Sub-Inspector (Operation) and Assistant Sub-Inspector (Technical) respectively. Only confirmed Assistant Sub-Inspectors will be considered eligible for promotion. Promotion shall be given on seniority-cum-merit basis, which will be considerable on the recommendation of the board of Director General of Police. This board shall be constituted under the Chairmanship of DIG (Wireless & Technical Services), or equivalent officer with two SP Rank officers as members and one of the two members must belong from the Scheduled Castes/Scheduled Tribes. Time bound and rules for this promotion shall be same as fixed for promotion from Assistant Sub-Inspector to Police Sub-Inspector of General Police Force.

(B)     Training.

It will be compulsory for Sub-Inspector (Operation) and Sub-Inspector (Technical) to pass the grade-I (Operation) course and grade-I (Technical) course respectively; as per syllabus of DCPW.

(C)     Probation Period and Confirmation.

Probation period for promoted Sub-Inspector (Operation) and Sub-Inspector (Technical) shall be of one year. Upon completion of probation period and service record being satisfactory during this period, they would be confirmed on the post of Sub-Inspector.

(V)     Promotion, Training and Confirmation to the post of Police Inspector (Operation) and Police Inspector (Technical) -

(A)     Promotion.

All posts of Police Inspector (Operation) and Police Inspector (Technical) shall be filled by promotion of such Police Sub-Inspector (Operation) and Police Sub-Inspector (Technical) respectively, who have passed the grade-I course. Promotion shall be given on seniority-cum-merit basis, which will be considered by the board of Director General of Police on the recommendation of rang DIG Board. Director General Board shall be constituted under the chairmanship of Director General of Police wherein Additional Director General of Police (Technical Services) will be a member and nomination of remaining members shall be done by the Director General of Police; out of which, one member must be of Scheduled castes/scheduled tribes category.

(B)     Probation period and Confirmation.

Probatsion period on the post of Police -Inspector shall be of two years. Confirmation will be done if service record remains satisfactory during this period.

Rule - 6. Reservation.

The State government provisions relating to reservation will be applicable to appointment and promotion to all posts of the cadre.

Rule - 7. Bihar Police Radio Organisation Headquarters.

The headquarters of Bihar Police Radio will be functioning at Patna and it will work on the model of District Police Office (with reserve office). Bihar Police Radio Organisation will function under Additional Director General (Wireless and Technical Services), and during him not being posted, function under IG (Wireless and Technical Services).

Rule - 8. Cipher Routine.

Bihar Police Radio Organisation shall direct the officials for training of suitable and worthy Assistant Sub-Inspectors and Sub-Inspectors for cipher training.

Rule - 9. Refresher Course.

Radio organization shall arrange refresher course for all ranks from time to time. Participants shall be given due importance in service potential.

Rule - 10. Pay and Allowances.

The officers/staff of the cadre will be entitled to the same payable salary and allowances as fixed by the State Government from time to time.

Rule - 11. Residual Matters.

All such matters which are not covered under these rules, or under orders issued under these rules, will be governed by Bihar Service Code/Rules/Resolution/Bihar Police Manual, as may be applicable in the State Government for the equivalent posts.

Rule - 12. Interpretation.

In case of any doubts relating to any provision of these rules, the Home Department (Police Branch) will provide the final interpretation/explanation regarding the same.

Rule - 13. Repealing and Amending.

(i)       The corresponding rules of Bihar Police Manual, 1978 will be considered accordingly amended after the provisions contained in Serial No. (I) to (V) of Rule No.-5 of these rules, relating to direct recruitment, come in to effect in Radio Organisation.

(ii)      The Bihar Police Radio (Telecommunications) Subordinate Officer (Operation) Recruitment, Promotion and Cadre Rules, 1989 as notified vide Home Department notification No. 368 Dated 06.07.1989 and corresponding previous orders/circulars/directions are hereby repealed.

(iii)     Notwithstanding such repealing, the previous decisions, issued resolutions/rules/orders in this matter and the actions taken in light of them would be deemed to be actions taken under these rules or under powers provided by these rules; as if these rules were in effect on that date.

This test will be of qualifying nature only. No marks will be awarded in these tests, but it would be compulsory to successfully qualify in all the physical tests.

2.        Run.
