Rule - 1. Applicability.

Applicable to all industries manufacturing certain products as indicated in the Act. The Act imposes the standards for emission or discharge of environmental pollutants and the industries are required to adhere to such standards.

Rule - 2. Duties and Obligations.

(a)      To see that the standards for emission or discharge of environmental pollutants, are within the limit as prescribed in the Schedule-I to the Rules. (The standards are specified for 79 product groups)

(b)      To maintain the ambient air quality standards as specified in the Schedule III to the Rules. (Different standards are set for industrial area, commercial area, residential area and silence zone- for day time and night time).

(c)      To adhere to standards for emission or smoke, vapour etc from motor vehicles as specified in the Schedule IV to the Rules.

(d)      To furnish information to the concerned authorities (as specified in Schedule-V) in case of excess pollution occurred or apprehend to occur, due to accident or other unforeseen events.

(e)      To maintain the emission or discharge of environmental pollutants with in the standards as specified in Schedule VI in case of industries, operations other than those listed in the Schedule I referred earlier.

(f)       In case of any emission or discharge to maintain the relevant concentration in ambient air as specified in Schedule VII.

(g)      To allow the empowered officer to take samples of air, water, soil or other substances for the purpose of analysis.

(h)     Every industry carrying on an industry, operations or process requiring consent under Section 25 of Water (P & CP) Act, 1974, or under Section 21 of Air (P & CP) Act, 1981 or both or authorisation under the Hazardous Waste (M &H) Rules 1989 issued under the E (P) Act, 1986 shall submit an Environmental Statement for the financial year ending the 31st March in Form V to the concerned SPCB on or before the 30th day of September every year.

Rule - 3. Consequence of Non-Compliance of the Requirements.

Failure to comply with or contravention any provision may attract imprisonment up to 5 years of fine upto Rs. One Lakh or both.
