PREAMBLE
In exercise of the
powers conferred by the proviso to Article 309 of the Constitution of India,
and in supersession of the Special Rules issued with G.O. Ms. No. 202, General Administration
(Rules) Dept, dated the 16th February, 1961, and as subsequently amended,
issued from time to time, the Governor of Andhra Pradesh hereby makes the
following Rules for the Andhra Pradesh Excise Subordinate Service.
Rule - 1. Short Title:
(i)
These Rules may be called the Andhra Pradesh Prohibition and Excise
Subordinate Service Rules.
(ii)
They shall come into force with immediate effect.
Rule - 2. Constitution:
The Service shall consist of the following
categories of posts in the Andhra Pradesh Prohibition and Excise Subordinate
Service:
Category:(i) Assistant Chemical Examiner.
Category:(ii) Prohibition and Excise Sub-Inspector.
Category:(iii) Prohibition and Excise Head
Constable.
Category:(iv) Prohibition and Excise Constable.
(Including Free Marker).
Category:(v) Steward-cum-Caretaker.
Rule - 3. Method of Appointment and appointing authority:
Subject to the other provisions in these rules, the
method of appointment and appointing authorities for the several categories
shall be as specified in the table.

1[Note:(1) (a) 50% of the substantive vacancies in
the category of Prohibition and Excise Sub-Inspector shall be filled by direct
recruitment.
(b) The remaining 50% of the vacancies to be filled
up by the following method:
(i)
25% of the vacancies to be filled up by transfer from the Junior
Assistants/Typists/Junior Stenos from the Andhra Pradesh Ministerial Service
working in the Excise Department.
(ii)
25% of the vacancies to be filled up by promotion from the category of
Nakedars, Petty Officers (Andhra) and Head Constables.
(c) In the matter of appointment to the post of
prohibition and Excise Sub-Inspector in a cycle of (20) vacancies, the first to
fifth and twelfth to sixteenth vacancies shall be filled by direct recruitment,
the 6th, 7th, 10th, 17th and 18th vacancies shall be filled by promotion of
Head Constables, the 8th, 9th, 11th, 19th and 20th vacancies shall be filled by
appointment by transfer of Junior Assistants/Typists/Junior Stenos as shown
below:

Note: (2)(a) In a cycle of (10) vacancies in the
category of Prohibition and Excise Head Constables the first nine vacancies
shall be filled by appointment by promotion of Prohibition and Excise
Constables and the 10th vacancy shall be filled by appointment by transfer from
the category of Drivers.
(b) For purposes of appointment by transfer of
Drivers as Prohibition and Excise Head Constables a combined seniority list of
Heavy motor vehicles drivers and light motor vehicles drivers will be prepared
in which the Heavy vehicles drivers shall be placed on top of the list arranged
in the order of seniority in that category, followed by light motor vehicle
drivers who will be in the order of seniority in that category.
Note : (3) In the category of Prohibition and
Excise Constables, in a cycle of (20) vacancies the first nine and 11th to 18th
vacancies shall be filled by direct recruitment and the 10th, 19th and 20th
vacancies shall be filled by appointment by transfer of Attenders of the Andhra
Pradesh Last Grade Service working in the Excise Department.
1Note : (4) In a cycle of every 22 appointments
from the category of Junior Assistants/Typists/Junior Stenos of Special
establishment and sub-ordinate offices, the 1st vacancy shall be reserved to be
filled in by the Junior Assistants or Typists or Junior Stenos serving in the
Special Establishment and the remaining 21 vacancies shall be filled in by the
Junior Assistants/Typists/Junior Stenos from the sub-ordinate offices].
Note : 2[(5) (a) Appointment of Prohibition and
Excise Sub-Inspectors by transfer or by promotion shall be made by the Deputy
Commissioner concerned from a list of candidates approved by the Commissioner.
(b) No addition to or removal from any of the list
of approved candidates shall be made without the approval of the Commissioner
of Excise.
Provided that notwithstanding anything contained in
the above notes, the seniority of persons appointed by different methods to any
post in the service shall be governed by General Rule 33 of the Andhra Pradesh
State and Subordinate Service Rules.
Rule - 4. Reservation of appointment:
(i)
Except in so far as it relates to physically handicapped persons, the
rule of special representation (Genl. Rule 22 of Andhra Pradesh State and
Subordinate Service Rules) shall apply to appointments made by direct
recruitment to all categories for which there is a provision for direct
recruitment.
(ii)
The General Rule 22 of the Andhra Pradesh State and Subordinate Service
Rules shall also be applicable to appointment by transfer to the post of Excise
Sub-Inspectors, except in so far as it relates to physically handicapped
persons and Backward Classes,
(iii)
(1) In the matter of direct recruitment to posts for which women are
better suited than men, preference shall be given to women;
Provided that such absolute preference to women
shall not result in total exclusion of men in any category of posts.
(2) In the matter of direct recruitment of posts
for which women and men are equally suited, there shall be reservation to women
to an extent of 331/3% of the posts in each category of Open Competition,
Backward Classes (Group-A), Backward Classes (Group-B), Backward Classes
(Group-C), Backward Classes (Group-D), Scheduled Castes, Scheduled Tribes and
Ex-Servicemen quota.
(3) In the matter of direct recruitment to posts
which are reserved exclusively for being filled by women, they shall be filled
by women only.
Rule - 5. Qualifications:
No person shall be eligible for appointment to the
categories specified in Col. (1) of the Annexure to these rules by the method
specified in Col. (2) thereof, unless he possesses the qualification prescribed
in the corresponding entry in Col. (3) thereof.
Rule - 6. Age:
No person shall be eligible for appointment by
direct recruitment to the posts of Assistant Chemical Examiner, Proh. &
Excise Sub-Inspector, Prohibition and Excise Constable and
Steward-cum-Caretaker, if he has completed 28 years of age on the first day of
July, of the year in which the notification for selection is made.
Rule - 7. Physical requirements:
(a)
every candidate for appointment by direct recruitment or by transfer or
by promotion to the posts of Prohibition and Excise Sub-Inspectors and
Prohibition and Excise Constables shall possess the following physical
standards:
(a)
For Men
(i)
Must not be less than 165 cms. in height.
(ii)
Must not be less than 81 cms. round the Chest on full expiration with a
minimum expansion of 5 cms;
Provided that in the case of candidates belonging
to S.Ts. where the required quota cannot be fully utilised for want of
sufficient candidates possessing the requisite height, it may be relaxed by 5
Cms. so that it shall not be less than 160 cms.
Provided further that members of the Andhra Pradesh
Ministerial Service working in the Prohibition and Excise Department, Drivers
and Attenders shall possess a minimum height of 163 Cms. if they are otherwise
qualified to be appointed as Prohibition and Excise Sub-Inspector of
Prohibition and Excise Head Constables respectively.
(b)
For Women
(i)
Must not be less than 152.5 Cms. in height
(ii)
Must not weigh less than 45.5 Kgs.
(iii)
Visual Standards:
All candidates, including women for direct
recruitment and appointment by transfer or by promotion as Prohibition and
Excise Sub-Inspectors, Prohibition and Excise Constables must be certified by
an Ophthalmic Surgeon (of the rank of Civil Surgeon in Government Service) to
possess the following visual standards:

(b)
Each eye must have a full field of vision.
(c)
Colour blindness, squint or any bordlid condition of the eyes or lids of
either eye, knock, knees, pigeon chest, flat foot vericos veins, hammber-toss,
fractured limbs or decayed teeth shall be deemed to be disqualification.
Rule - 8. Minimum service:
No person shall be eligible for appointment to
transfer or promotion to any category, unless, he has put in not less than (3)
years of service in the category from which promotion or appointment by
transfer is made.
Rule - 9. Probation:
(a)
Every person appointed by direct recruitment to any of the posts in this
service shall from the date of which he joins duty, be on probation for a total
period of (2) years on duty within a continuous period of (3) years.
(b)
Every person appointed to any of the posts either by promotion or by
transfer shall, from the date on which he joins duty, be on probation for a
total period of one year within a continuous period of two years.
Rule - 10. Tests:
Every person appointed by direct recruitment to the
post of Prohibition and Excise Sub-Inspector shall pass the following tests
within the period of probation,
(i)
Excise Departmental Tests;
(ii)
Accounts Test for Executive Officers;
(iii)
Third Class language test in any two of the following languages of which
one shall be Telugu.
(i)
Telugu
(ii)
Urdu
(iii)
Hindi
Explanation: A pass in the test, examination or
examinations specified in item (1) or (2) below shall be regarded as equivalent
to a pass in Test (a) Criminal Law which is included in the Excise Departmental
Test.
(1)
(A) The examination of a Degree in Law of a recognised University.
(B) Part-II (Criminal) of the apprentices
examination held by the High Court of Andhra Pradesh or the examination in the
Law of practice and procedure held by the Bar Council.
(2)
The Criminal Judicial Test conducted by the Andhra Pradesh Public
Service commission.
Rule - 11. Training:
(i)
Every person appointed by direct recruitment or by transfer to the
categories of Prohibition and Excise Constables, Prohibition and Excise Head
Constables, Prohibition and Excise Sub-Inspectors and Assistant Chemical
Examiners shall, immediately after appointment, undergo a course of training
for such period and as per such programme and syllabus as may be prescribed by
the Commissioner of Excise from time to time.
(ii)
Every person appointed by direct recruitment shall, before the commencement
of training, execute an agreement to the effect that he shall serve that
department for a period of three years, after completion of training referred
to in sub-rule (i). He will be liable to refund to the Government, the pay and
allowances or any other remuneration received by him in addition to the amount
spent by the Government, on his training, if;
(a)
he fails to serve the department for a period of (3) years after
completion of his training for any reason; or
(b)
he discontinues the training or is discharged from training course for
misconduct of any other reasons; or
(c)
if he secures any other employment elsewhere other than under the State
Government,
(iii)
the period of training shall count for purposes of probation,
increments, leave and pension.
(iv)
A direct recruit shall be eligible, during the period of training, for
the initial pay of the post with usual allowances admissible at the place of
training.
Rule - 12. Pre-service posting:
(1)
Every person before appointment as Prohibition and Excise Head Constable
by transfer from the category of Driver shall be posted to work as Prohibition
and Excise Constable for a period of at least one year before he is posted as
Prohibition and Excise Head Constable. During the period of posting as
Prohibition and Excise Constable, he shall continue to draw the pay and
allowances as a Driver and this period shall not count for probation in the
category of Prohibition and Excise Head Constable.
Rule - 13. Unit of appointment:
For the purpose of recruitment, discharge, want of
vacancy, seniority, promotion, transfer and appointment as full member, the
unit of appointment for the various categories of posts shall be as specified
in Column (3) of the Table below:

Provided that the posts of Prohibition and Excise
Sub-Inspectors in the offices of the Assistant Commissioner, Distilleries and Distillery
Officers, shall be filled on tenure basis by drafting persons, equitably from
different zones and the period of tenure shall not ordinarily exceed three
years.
Rule - 14. Transfers and Postings:
The appointing authorities specified in Column (3)
of the table under Rule 3 shall be competent to effect transfers and postings
of persons in the respective categories within the Units referred to in Column
(3) in the table in rule 13.
However that the Director of Distilleries and
Breweries is competent to effect transfers and postings of persons working in
the Distilleries Wing within his jurisdiction.
Rule - 15. Savings:
Nothing in these rules shall affect the
appointments made in accordance with the repealed rules prior to the coming
into force of these rules.
