THE ANDHRA PRADESH DISTRICTS (FORMATION) AMENDMENT ACT, 1985

PREAMBLE

An Act To Amend The Andhra Pradesh Districts (Formation) Act, 1974.

Be it enacted by the Legislature of the State of Andhra Pradesh in the Thirty-sixth Year of the Republic of India as follows:--

 

Section 1 - Short title, extent and commencement

(1)     This Act may be called the Andhra Pradesh Districts (Formation) Amendment Act, 1985.

 

(2)     It extends to the whole of the State of Andhra Pradesh.

 

(3)     It shall be deemed to have come into force on the 11th January, 1984.

 

Section 2 - Amendment of section 2, Act 7 of 1974

In the Andhra Pradesh Districts (Formation) Act, 1974 (hereinafter referred to as the principal Act) in section 2, in clause (e), for the words "taluk, firka" in the two places where they occur, the word "mandal" shall be substituted.

 

Section 3 - Amendment of section 3

In section 3 of the principal Act,--

(i)       in sub-section (1), for the words "and each revenue division shall consist of such taluks and each taluk shall consist of such firkas and each firka shall consist of such villages", the words "and each revenue division shall consist of such mandals and each mandal shall consist of such villages" shall be substituted;

 

(ii)      in sub-section (2),--

 

(a)      for the words "taluk or firka" wherever they occur, the words "or mandal" and for the words "taluks or firkas", the words "or mandate" shall respectively be substituted;

 

(b)      the proviso shall be omitted;

 

(iii)     in sub-section (5), for the words "taluk, firka", the word "mandal" shall be substituted.

 

Section 4 - Substitution of "Commissioner of Land Revenue" for "Board of Revenue"

Throughout the principal Act, for the words "Board of Revenue" wherever they occur, the words "Commissioner of Land Revenue" shall be substituted.

Section 5 - Transitional provision

Notwithstanding anything contained in this Act, the areas, boundaries and names of the taluks and firkas in the State existing at the commencement of this Act shall continue until mandals are formed in accordance with the provisions of the principal Act, as amended by this Act.

 

Section 6 - Repeal of Ordinance No. 5 of 1985

The Andhra Pradesh Districts (Formation) Amendment Ordinance, 1985, is hereby repealed.
